But can the courts prove that he was actually smoking something illegal? Lots of legal hurdles. It'd be like going after everyone here that post that they were gambling on sports.

No case has ever been brought for "using" marijuana.
Marijuana - in some quantity - must be introduced into evidence in order to successfully prosecute a charge of possession.
In the case of Tunsil, he can be filmed ingesting (alleged) marijuana.....one or more people can testify they saw him doing it, but unless physical evidence of the illegal contraband is introduced at trial, any competent defense attorney - top 20 law school or lower - can contend the ingested substance was something else and no prosecutor in the USA would succceed in bringing "possession" charges.
