4) The maker of the bat for not making it bigger so the batter could make better contact.
5) The catcher for not catching the foul ball.
6) The umpire for not getting in the way of the ball.
7) The net for not acting like a wall; instead having some give.
8) The fans around her for not telling her "down in front" while she was standing up directly behind the batter/catcher/umpire during live action with her head against the netting.
9) The Pirates for allowing people to sit so close to the plate that they get hit when they have their back turned to the action.
They ought to get a healthy settlement out of it, so she can afford upper deck season tickets where she can have her back to the action all game long without being in danger.

I would just argue that if it wasn't safe, why did the person employed by the stadium, the usher, walk her down to her seat? It's not like she was walking along the lines and got hit. Why was there so much give in the protective net?

I just don't see the "big" lawsuit everyone is envisioning. Yeah, she'll sue and get a settlement but it will be relatively small. She still has to prove damages. Didn't someone post that she left the hospital the next day? I'd think her medical expenses were fairly low if she did indeed get released the very next day. Makes me think pretty much all the bills would just be for diagnostic tests to confirm she was ok to be released.

Without being able to know the longterm effects or at least potential effects of a blow to the head such as this but with ample evidence suggesting possible negative longterm effects (concussion knowledge growing) with a skilled lawyer she prolly has a better case than it seems to you.
Yes, I agree that its on the surface at least much ado about "nothing" now that she appears to be OK but legally speaking....?
Its still my sense that the contract on the back of the ticket protects the team but obviously they should, just because it'd be the most intelligent approach from an "avoiding negative PR" perspective, cover her medical expenses and give her a bit more $$$ for pain and suffering. A wise investment when compared to all The Hell they'd catch from the Internet Warrior crowd if they try to weasel out here.
