Thoughts? This is going to be a tough conviction despite the black community yelling about a black man being shot unarmed in his own apartment.

Negligent homicide?

What makes you say this is going to be a tough conviction?

I think the jury is going to deliberate for about 4 hours before finding her guilty.

She was not acting in an official capacity as a police officer. She was not in reasonable fear for imminent danger or death. She was grossly irresponsible and completely wrong.

To give you an analogous story: A man was dating a woman with a violent ex-husband. The ex husband left multiple messages on the man's answering machine saying he's coming over there to harm the both of them. The crazy ex came to the man's home and was pounding on and kicking the door saying "I'm going to kill you"
The man fired a shot through the door killing the crazy ex.

Outcome: he was charged with manslaughter and convinced.

Of course, there is no thread on the RX: It is a white cop shooting a black guy. Nothing to see here.

But, to analyze the cop's story, it seems unlikely that a guy is at home in his own apartment with all of the lights out (unless he is asleep), and the front door ajar. It will be interesting to see what he was wearing when he was shot. Pajamas?

I think the he cop is making up the part about the lights being out and her giving verbal commands. She thought it was her place, walked in like anyone does after a day of work, and blasted the guy at first sight.

Sounds about right her story doesn’t float

I think she’ll be convicted too. I just see 2-3 jurors having doubt about what to convict her of.

Correct. A murder charge will never stick. Unless some new evidence comes out she knew the guy and had a motive. Bizarre story for sure with some details so far seeming really sketchy. Curious how this one unfolds as well...

Here is an example of where you go off the rails and why people dislike you. When given a chance to debate the given subject or to debate another poster, you always choose the later.

There are many more reasons than that why people dont like enfuego,,

It will be a miscarriage of justice if she isn't serving at least 20 years in prison if not more.

Manslaughter in Texas carries a sentence of 2-20 years. Let's just hope they don't take into account intoxication manslaughter by sleep deprivation, and her being a cop on top of that, and she walks with time served, probation, a fine, and community service.

IMO, unfortunately, I think she gets somewhere between the BS charge mentioned in the latter, and 10 years, where she serves about 7 total. No way IMO they get her for murder, so anything over 20 years seems out of the question...

This story was on the news this morning.

I just caught the headlines where they say the family is saying she is lying.

I'll look for a video. CBS news.

I thought of that, too. If the apartments are exactly the same, wouldn't the light switches be in the same place? Doesn't every apartment have a light switch directly inside the front door? Cops would automatically turn on the lights to see what they need to see.

And, after you turn on the lights, it would be totally obvious that it wasn't your apartment due to the furniture.

Pretty obvious the woman did nothing wrong - it was very dark in the apartment and this guy is black

I'm just waiting to hear from the neighbors that the woman hates blacks and hated this guy

If this goes to trial and she testifies, the defense team is going to have her looking like a 20 year old girl on her way to Sunday School. She's going to then recount the time in college she came home to her dorm room late at night and the guy from the basketball team tried to touch her junk and this event triggered that horrible memory.

If she gets acquitted, Dallas will see riots.

I wouldn’t advise she testify. She’s already been involved in one shooting a few years ago too.
