again, it does not matter if your kids new family needs doesn't need your money, you have to pay it. The electric company will not go broke if I don't pay my bill, but I can't go to court and say that I'm not paying because the electric company doesn't need my money.

So buddyboy, the mother doesn't have to pay her share according to you?

I am to pay my 100%, and a portion of hers?

Who pays for the 100% of the time while I have her?

We split custody, what part do you not understand, I have my child 50% , that means I pay half already....

Obviously you have not been in this situation.

As of 1996/1997 (Whichever yr Syr beat ky in the NCAA) in indiana you can request xtra visitation, anything other than every other weekend and get an immediate 15% reduction. Even if only 2 weeks in the summer. Maybe that will help, I dunno. I have paid support for my Sons since then and I could complain at my payments as well, but choose not to. If I were gonna fight the system it would be over taxes, not support. I, as you jman, spend alot of xtra on my Sons. I can see your point, but it is a losing battle and one not worth fighting nor worrying over. We should have thought about it when we filled that eclair. :hump:

I see, you are saying because you have her 50% of the time and her mother has her the other 50% then it should be a wash.

that would work. but then would you guys also split the medical insurance, and clothing cost as well? Money needed for the dentist? School trips? Wouldn't it be easier just to give your ex a couple hundred a week so you wouldn't have to be hassled with itemizing and accounting? or is it the thought that you could be getting ripped off that is really driving you crazy.

Too bad that is not even close to how most states figure child support. Most states base it on GROSS income and income shares - which is a formula that screws over whichever parent is not given legal custody.

Basically most states take both parents GROSS income and combine them to come up with a MONTHLY income that the child is entitled to. Emphasis on gross income because taxes and other obligations (such as what they spend on their child for shelter, clothing, etc.) are not considered. Once they have this magic number, they plug it into a chart and come out with the monthly "AWARD' and believe me, if there are attorneys involved it is just that - an award - because the more they can drag this out, the more money they will make, and whichever parent gets the AWARD it is TAX FREE since the presumption is that 100% is used for the child. The parent paying the award gets to pay the tax on it and does not get any credit for that payment, except for meeting their 'obligation'. .

So basically for Jman, the fact that his ex has little or no income actually REDUCES his potential expense, because if she made a lot of money that would increase the monthly award. It sounds crazy, but believe me , this is what they do.
