I discount near Death, it's just another state of life. Real dead is a state all to itself. Unless you are clinically dead for 3 days, you can't count your experience as anything but O2 deprivation. Until you begin to smell, you ain't dead.
True death may be final for the body but consciousness is not bound by that definition.
Many documented NDEs include verified perceptions during clinical death that can’t be explained by oxygen deprivation alone.
Dismissing them outright is easy.
