There are always exceptions to everything. I'm sure if she decides to sue, her attorney will argue that although there was a protective net, it didn't do what it was designed to do. Did her ticket say to stand at least two feet away from the net? Was it reasonable to expect that you could still get hit in the head with the protective net in place?
One would think that PNC park will step up and cover her medical costs. Who knows how this will end.
She pretty much has to Sue, doesn't she? Net may have not been operating properly...among other things a lawyerly mind would think of. Why wouldn't she sue other than potential legal costs? I'd reckon there'd be lawyers lining up to take the case Pro Bono. For the potential of publicity, getting their name on TV, head in front of a camera. I can't think of any sensible reason she wouldn't sue. Easy out of court settlement, as others have alluded to. MLB don't want the negative PR of a court battle with a woman who got knocked in the head by a baseball.
Wouldn't MLB's insurance cover a payout anyways?
Possible this Lady & her lawyer make 300,000 or so from this. Surely not more than that....yes?
