Doesn't ALLOW? When did they given you permission to repost their picks? They never have, and never will. Picks are opinions, there's nothing they can do legally besides retract your subscription without refund.

Back to regular scheduled programming.....

Wrong. They can legally SUE and as stated the cost of being sued is NOT WORTH it to the RX. Even if you win you are out a lot of money. Simple to understand. My goodness

So how come all these porn companies don't sue websites where their videos and pictures are plastered for free and for everyone to access?

The way I understand it is that the site is the one who would be sued for allowing the plays to be posted after it has been posted not to post them I wonder why Wagertalk hasn't said anything their cappers gave been listed on here not to post for a long time lets just wait and see what happens besides Root and Big Al are the ones that get posted here the most of that list I am sure we can work around it

I absolutely promise this will be my last comment on this subject.

Phil Steele/Northcoast has been around for over forty years and with the annuals and weekly publications have as much money

if not more than any service out there.

With their picks so readily available all over the internet, the question is why hasn't Steele/NC ever sued any site or to the best

of my knowledge any client or anyone else who has posted their picks??

Steele is a miserly/cheap person, and it just seems to me that if anyone knows if suing would bring positive results it would be him/NC!!

BIG AL is a LAWYER. His cost of the filing fee would be his ONLY cost. RX would have to get a lawyer. This is a simple concept. The COST of being sued outweighs everything else. Porn companies would have the same cost unless Betty BIG BOOBS Bopper is a lawyer too. Nobody is listening to me so I am done. LOL

It would cost him time though and with the mlb season getting ready to go I don't think he'd have any to spare. Its a scare tactic at best. Then again he's not threatening me with a lawsuit lol

Your logic only makes sense if someone can't afford to pay a lawyer AND/ OR is convinced they can't win the case. I mean how much realistically would it cost for the Rx lawyer(s) to work this case? $10k? $20k..... that's really not that much money for a business. In fact, most serious businesses budget for legal services in their annual budget. But in all reality, this case would be dismissed as frivolous.

Savage makes a good point... Big Al has been a lawyer longer than he has been a tout. What changed all of a sudden today compared to 5 years ago? 10 years ago? Sure, there is probably some compelling moral or ethical argument you could make that would argue that posting someone else's picks is the wrong thing to do but I don't think you can make a legal case out of it. What serious judge in this country would be convinced that there is some sort of legal precedent that prohibits people from posting sports picks of touts on an anonymous message board?

When u look at that list of 20 services there are only 2 that are posted on a regular basis I am sure we can work around this so people can get the plays

I am an attorney and don’t practice in states involved nor do I practice in that area of law however, I doubt he has a legitimate cause of action. My suggestion would be to take the letter he sent and consult with an attorney who would give you his opinion for less than $500 or his hourly rate for a 1 hour consult. I have practiced 25 years and if I had a $1.00 for everytime I heard someone had an attorney or told me they were going to sue a client… I would be rich. I would guess that the letter didn’t even come from an attorney and probably from Al himslef. If it came from an attorney …. It probably doesn’t even state a legitimate cause of action. There is no law that I know that says you can’t relay a pick from a paid service. The client who paid for the pick could have his subscription canceled as that would be a breach of his agreement it’s big AL…. But I am pretty certain AL wouldn’t prevail but that might not stop him from suing. In my state, most attorneys would not file a lawsuit that has no basis as you could get sanctioned by a judge if the lawsuit is baseless. This sanction would lead to RXs attorney fees being reimbursed if the judge found the lawsuit to be frivolous.
