As far as being toxic-- when it started getting bad years ago, they did something about it. Here's pertinent snippet from that url:

Besides if it were un-safe do you really think we would let you swim in there, let alone what the state or coast guard says. Not to mention you start and finish at the beach on the island. So at worst, depending on the exact point, you'll have to make sure and dodge any vessel, maybe its waste, the CG, police boats: read here
