So what exactly might one plea to instead of this rape charge ?
I have a problem figuring what the lesser ( misdemeanor ? ) charge might be ?
It is unwise to screw with 15 year old girls....unless you are like 14-17, IMO !
However it is inappropriate to ruin this young man's life with a rape charge. It's not like he abducted her , she did it willingly. the girl may have even been more sexually experienced than the guy.
There should be a better way than just saying 16 is the magic number. A girl could be a day short of 16, that's rape, but if she were two days older it's then fine ?
Tossing this guy in prison is not called for..... if everything is factual.

I agree Sean ! This is the time when you you need the best lawyer you can get ! This is major stuff not some misdemeanor charge.

To me rape is like physically overpowering a woman to have sex she doesn't want. I don't see how that would even be pleasurable.

Get a good lawyer, and it will be expensive. I wouldn't plea to anything if I was him. This type of charge will stick with him forever as he more than likely will have to register as a sex offender.

It sounds like the mother has failed her daughter over and over and drove her to mental instability. Instead of addressing the relationship issues with her daughter that drove her to seek counseling and multiple stints in mental institutions, the mother wants to use your nephew as a scapegoat and say the sexual relationship she entered with a slightly older gentleman is the reason for her daughters issues. I am sure the mother is pampering her daughter right now and the daughter is going to play along with the witch hunt because of the attention she is getting.
that's kind of a 17 0n 14 type of thing. I'd also think that a senior would prefer someone from his own class. definetly not cool to be 17-18 in HS and dating some 9th grader.
In fact when you are young like say 18-25....it would be very cool to have a G/F that was older...like 25-35....once you're 40 you want the girl to be closer to 20, though !
Bingo. Unfortunately, this is black and white. The girl is 15. She may have lied about her age, but the prosecution can still turn it around on your nephew for not ID'ing her (who the hell would do that, I know). But if he actually admitted to sleeping with her, both parties saying its consensual or not doesn't matter. She's 15. That number gets a conviction.
Haven't you ever dealt with those type of parents who have kids that get into all sorts of trouble and do alcohol and drugs and have sex and instead of looking in the mirror and realize that they didn't do as good as a job raising their kids as they should have they like to blame the behavior of their child on somebody elses child by saying your child is getting my kid into trouble.
I hate parents like that. Their kids end up worse in the long run and grow up to be rotten adults or full time losers because their parents never taught their children to take responsibility for their actions.
