Automotive supply chain Pep Boys fired a Tucson store manager because his military Reserve duties took him away from work, according to a federal lawsuit filed here.

It may not be an isolated case. Several other reservists fired from Pep Boys in Tucson and Pennsylvania have contacted a military advocacy group with similar complaints.

Yup, they better make up a different excuse for his termination.. they are DEAD wrong.

its not as if he'll be able to work from the USS Aggressor in the Persian Gulf...
What else could they have done? What would have been the "american" thing to do?

Having been a reserve, I know this first hand. And the article even states it...

THE LAW:
Federal
A person who is a member of, applies to be a member of, performs, has performed, applies to perform or has an obligation to perform in a uniformed service shall not be denied initial employment, re-employment, retention in employment, promotion or any benefit of employment by an employer on the basis of that membership, application for membership, performance of service, application for service or obligation.
State
An employee has a claim against an employer for termination of employment only if one or more of the following circumstances have occurred:


The employer has terminated the employment relationship of an employee in retaliation for any of the following:

Service in the national guard or armed forces as protected by (state law).

What they most likely did was offer him a job upon his probable return, no? I just have a hard time believing that they would so blantantly discriminate.
 
ok I can see why the guy would be pissed but I can see Pep Boys side also !

What's Pep Boys to do ? Keep paying him his montly salary while the dude is out in the persian gulf BusHitler his little Iraq excursion ?

God knows how long those troops are going to be there, meanwhile employers will still have to pay the reserves their montly salary without getting anything back ?

The idea of paying an employee while he is not working is a tenet of socialism. It seems that the conservs are all for it when its an army reservist. But mention single mothers and there'd be no contest.

Guys,

The employer is NOT forced to PAY an employee while performing his reserve function, wether after being called up, or doing his/hers one weekend a month, and 2 week stint a year.


What IS required, is that the emplyer must HOLD the job, with out discrimination, for any one performing his reserve duty, for a period of less then 3 months. After that, the rules slightly change, but are similiar.

Some employers DO choose to continue to pay the employee, but that is there choice, not required.

again, I don't think that a major chain would so blantantly discriminate. I could be wrong. I would hire a temp worker until he returned, easy way to appease all parties.
 
imo, anyone that thinks somebody should lose their job for serving their country is a jackass. hell at the company i work for, if you are called up they continue your full salary for a year, then after that, they supplement your military pay so that you make at least as much as you would if you were still at work.
