Title of this thread should be..."Is there a contractor in the house?"

Never mind the GC/SC relationship....in mosts states...even if you pay the GC AND the GC pays the SC......even a material supplier who wasn't paid by the SC can lien yo ass.

I wouldn't worry about it too much though. Chances are...GC, SC, or material provider never filed Prelim. on your property and that is a good thing for you.

Your "trainer" should tell the SC to fcuk off.......if SC sues, your bro just countersues the GC for said amount and more and legal fees. All good.

But like I said....he needs to find out if anyone filed the proper preliminary info for the lien (varies by state)

Wow...you hire some guy to do some work & he stiffs his contract "employees"(technically they are not), and now you're on the hook to pay them?

Maybe I'll stick to doing it myself or look into hiring illegals. Damn, what a mess(pc term for FUCKJOB).

I'm an attorney - though Journeyman says I'm not - the question is whether or not he can record a mechanic's liene against your property under these circumstances - there's two issues - the work was never completed and a third party is alleging he is owed - I'll get you an answer and what you can do if he attempts to get a lien - and if he does get a lien - just because he gets a lien does not mean you can't have it removed without paying - laws very from state to state

holaJust got back and got the full story on this. Seems the trainer sighned a semi contract , more like the original bid. The contractor asked for 21,000 and said when he got to a certain point would get the balance. Every day the contractor kept asking for more money way before he was cupposed to get anymore.he kept giving excuses after excuses for not finishing, so finally Sam said he would release him from the rest of the contract and get someone else to finish it. That seemed okay to the main contractor and then two or three days later is when this sub starting showing up asking for monies for work he said he did. Sam asked him to get it from the Main contractor.. That's where it stands now. The sub said he would place lein, however i doubt that he would. Who knows. Sam has a receipt for paying and showing job wasnt completed.

100% correct in florida. it;s the homeowners responsibility that all subs are paid.
But how does he know that the sub did the work. Sam said he never laid eyes on the guy before and the main contractor was the guy he saw do all the work when he was there. H:howdy:e said it was just a two man crew. it sounds like a hose job to me
