for the sake of discussion, besides my 2 questions, does anybody have any workmans comp stories from previous experiences they'd like to share? good/ bad ? I'd like to hear em'!

I had a stack of guardrail topple over on me last month and pin me by my ankle to the tractor trailer I was workin off of.. my shit got FUCKED UP, my bone was stickin out and the ligaments were shreaded. Shit felt like spaghetti danglin, just a nasty nasty feeling. I went to the hospital that night, they shot me up with ketamine and put the ankle back in place sorta & the next morning i had surgery. Now i got temporary rods & a plate im gonna have to deal with the rest of my life

Its only been a month, but so far so good with workmans comp.. im gettin my checks on time and luckly i qualified for the max amount... All my bills have been/are being payed, there providing transportation to my dr appointments, and i got everything i need to hobble around the house for the time being. The dr. im seeing is the one who did my surgery, its not some random WC doctor they picked, tryin to rush me along.
my dr. said it could possibly be a year until i heal 100% & am able to go back to work full time... im a laborer and theres nothing light duty about anything i do (guardrail, fence , & asphalt )

i got 2 questions to anybody thats ever deal with W.C.
if it gets to that 12 month point, you think they might try to just make a settlement with me ?
and from what i understand the workmans comp checks arn't taxable, is that correct ?
Im in Jersey, but i cant imagine workmans comp varies that much from state to state, so any input would be good input

Don't settle until you feel like you are healed as best you can heal, that check for the settlement means that you can never go back on them again.

No not yet.. I dont know how any of this works so i guess i have more questions about that as well. Im not looking to personally sue the company i work for, were pretty tight knit thru friends & family & my spot on the crew is there for me when i eventually do heal up. If i ended up getting a lawyer involved, it would just to be to go after workmans comp (i think ?) If i do eventually end up getting offered a settlement, mabey than i should talk to a lawyer ? What could a lawyer offer me beforehand ? Im really not having any issues at the moment, & id rather just get the checks for the time being... Down the line if i start to get jerked around definately.

My friend was an iron worker and he told me he got hurt a couple years back & was out for 18 months... It got to the point that The company he worked for said they were going to fire him, so thats when he sued them. He won, than was 'kicked out 'of the iron workers all of a sudden... He lived 8 months off that money than was broke again startin a new career all over.

He must of had a shitty lawyer. I've seen 7 figure settlements for less.

Definitly get a lawyer and if you dont feel 100% in a year do not let them rush you back to work. They will say you are ready for light duty but if you have any pain at all screw em. Think about the fact that you will have pain for the rest of your life. Not easy to put a $ amount on that. Good luck with your recovery

You only have workers comp claim for certain time. Then it comes st or lt disability claim.

Cracked Elbow 25 years ago and accepted "their check" and was one of the worst decisions of my life,but 15k looked real good at the time and I hated working there and quit when I got the check...As much as I hate Lawyers,I wish I would have went that route...Still have pain to this day...

The bad thing is there is a dollar amount that has been settled for any injury. They will try to get you to just take the first offer so that is where the lawyer comes in. I got my knee run over and whatever money i get wont be worth the pain but at least i have somebody fighting for as much as is possible

two things

1) W/C not taxable (if you're going for Social Security Disability, what the SSA gives back to WC in lump sum settlement may be taxable, just beware)

2) hire a highly regarded WC attorney

True, you can't imagine how much it varies from state to state. Know little about NJ, more about OK and TX.

True in states with Oklahoma, not true in Texas.

You would be suing Insurance Co. not the Company you worked with........ I was told after I was in car accident I wouldn't be suing a friend it would be his Insurance Co......... Not sure how WC works?

I caught 21 of them. They're ruthless. I finally ended up screwing back with them and they seemed to calm down.

No doubt , I've heard stories about that kinda shit... I'm gonna be takin it easy with the social media as well. God forbid Facebook updates my location or I post pictures from an Eagles game or somethin!
