Their only source for appeal is to reach out to Goodell and hope he or a designate of his choosing revises the punishment. The Patriots are members of a franchise of leagues and are contractually bound to follow the NFL’s constitution and other legal instruments. The NFL’s constitution makes clear teams can’t take their grievances to court and that any attempt to do so would likely be futile. Like the other 31 NFL ownership groups, Kraft has agreed to abide by the Constitution and assented to not sue the league or other owners.

Unlike players, owners don't have the same rights. Something I have alluded to previously although I did believe Goodell was so over the top that Kraft would take him to court. I think Kraft is going to try and modify the commissioner's power at this point, having witnessed first hand what a big mistake he made by fighting to give the commissioner all this power. It's the same reason the Saints didn't fight.

Was something negotiated pertaining to Brady? IDK, I don't think so. I think Brady wins his case on it's own merits so Kraft didn't need to do so, but he may have.

I'd be surprised if something isn't changed with respect to Goodell's powers over teams, some internal oversight

As for Brady, it's a totally different game. In recent years, we've seen one high profile case get overturned by an independent arbitrator assigned by Goodell and two more cases overturned in the courts.

Since Goodell assigned himself to be arbitrator, I see Brady's case going to court

My thought/ opinion is Yes... he Probably did it to smooth things with the NFL
They Might give Brady a break on the 4 games.

Don't fight the Fine ( Kraft don't give a crap over money , he has plenty of it )
Yeah he loses a first rounder, another draft pick.. they can deal with that.
Just protect his QB ... isn't that what's it's all about ?

The league and the Patriots were talking all day yesterday. I think the deal in the making is for Kraft to take the business hit with the draft picks and the league will reduce Brady's suspension to two games. Kraft doesn't care about the money he is fined. He wants his meal ticket back on the field.

Exactly. Kraft knows Pats and Brady are guilty. Hell, anyone outside of Boston knows they're guilty. Second time busted for cheating.

OMG

aren't you involved with law enforcement? do you create evidence? discard evidence that doesn't serve your purpose? assume a minority or somebody you don't like is guilty while assuming somebody you like is innocent under the same circumstances? when everyone on the highway is speeding, you pull over one person and lock him up for reckless driving? Do assume somebody is more likely than not guilty because his cousin once was the only person convicted of underage drinking at a party where 30 other underaged people were drinking?

The Commissioner probably spent 30 minutes with Kraft reminding him that Brady didn't cooperate and neither did his organization. He also probably reminded him of all the texts and how awful the Patriots look continuing to deny reality.

If you own a dunkin donuts franchise, it's pretty tough to sue and take corporation dunkin donuts to court. As chop said, very similar to bensons options after bounty thing.

And at this point going to court is Kraft only real option. Only 2 owners have done what Kraft would have to do, sterling and al davis. I don't think someone who has krafts pedigree wants to be mentioned with those two.

a LOT of pats fans are mad at Kraft for doing this yesterday.. But I understand where he's coming from..

Now he can go back to his other owners and literally print money, no matter how incompetent virtually everyone associated with decision making in the league is.

the amount the owner/team was fined was less than the amount that they would have paid Brady. After paying the fine the pats are saving +800k. they'll still sell same amount of tix, still get same amount of TV royalties. and will still prob make the playoffs with a QB that has played 4 less games then the other teams.

what is there to appeal?
