The case is being prosecuted by the U.S. Attorney's Office for the Eastern District of Missouri and the Criminal Division's Organized Crime and Racketeering Section. Kaplan is currently being held in a St. Louis County Jail awaiting a trial that could result in a Federal prison sentence of more than 83 years and fine in the millions. He was arrested in March of 2007.
Odds are he may never be a free man again if the RICO charge sticks. He turned 50 last month.

As far as I know there is no trial date set as of today, one would think Kaplan is entitled to a speedy trial as part of his due process.
David Carruthers is also waiting for his trial, not sure if they will be co-defendents.
Carruthers was released on bail August 16, 2006. His conditions of release include a $1 million bail bond and that he must remain under house arrest in a hotel in Clayton, Missouri, 24 hours a day (only being permitted to leave the hotel for court appearances, meetings with his attorneys or medical emergencies).
He must also wear an electronic tagging device so that his movements may be constantly monitored, and it was required he get a dedicated phone line installed at the hotel.
Carruther's situation while it probably sucks has to be much much easier to handle than sitting in a county lockup like Kaplan is doing.

Gary Kaplan was a great man!!! I spent many many hours at his house with his family and he loved his wife and kids, the man was the best father i've seen in many years, never did drugs and was great in the kitchen
