Travelers beware: U.S. agents now have the authority to seize and retain laptops indefinitely, according to a new policy detailed in documents issued by the U.S. Department of Homeland Security.

As part of border search policy, government agents are now authorized to seize electronic devices and inspect documents in them, the document states. The electronic devices might include laptops, cell phones, portable music players or storage devices such as portable hard drives.
Agents with U.S. Customs and Border Protection will also be allowed to translate and share documents with other government agencies.
The DHS document, issued July 16, appears to state publicly a policy that has already existed. Laptops and electronic devices have been subject to search in the past, and travelers have reported not getting their devices back. The policy has drawn strong criticism from lawmakers and nonprofit groups, who charged that the searches were invasive and a violation of an individual's privacy rights. Computers contain a vast amount of private information about family, finances and health, which could be easily copied and stored in government databases, the Electronic Frontier Foundation has complained.
The policy document states that being able to examine documents and electronic devices is crucial for "detecting information concerning terrorism, narcotics smuggling ... contraband including child pornography, and ... other import or export control laws."
The new DHS policies allow customs agents to analyze the contents of laptops without any suspicion of wrongdoing, U.S. Senator Russ Feingold said in a statement.
"The policies that have been disclosed are truly alarming," Feingold wrote.
The policy could blur the distinction between "search" and "seizure," which could also allow DHS officials to steal personal documents from laptops it has retained, Feingold wrote.

This does not worry me too much. A best they will find an extravagant collection of great porno videos. Though it is disturbing that property can be ceased with little or no probable cause, the simple solution is don't travel with your laptop if you don't want it to be (possibly) ceased.

On the bright side, it means less waiting in line with security because more travelers will be scared to take their laptops. It means I will get the my gate quicker ;)

What's next, they can search your computer if you want to use a train or bus?

No...not anything they deem fit.

US borders have always been subject to search and seizure.

All airports are considered US border...for obvious reasons.

That is why TSA personnel can rifle through all your belongings....same as it ever was.

You can do a quick Google search. Read an article on how to "DHS Proof" your laptop prior to traveling. My personal opinion is it is a waste of time. If they can't get into your laptop with you there, then I would imagine they would just seize it and you are SOL.

I AM already THERE, travel laptop that gets reformatted before each trip to military specs.......and then a clean image is restored, there is no need to risk anything when crossing borders (And the US is NOT alone , Canada has the lead.......on inspecting computers for NO REASON WHATSOVER)

obviously I dont travel with anything sensitive in the laptop at all these days, its safer to just download it via encrypted channels before/after the trip

Yeah....and think how much fun it will be to defend yourself against charges that one or more of the porn video files includes underage performers.

The real key is to carry your entire hard drive on one of those small storage devices that could be easily stashed in such a way that only a major detailed search of your luggage would reveal it. Then clean your laptop files down to original and oh yeah, don't forget setting the desktop wallpaper to read in 72 pt colored font - FUCK THE DHS

two wrongs in one post

there are many reports of people that have NEVER gotten it back

also I have nothing to hide NOR TO SHOW to anyone that simply 'asks for it', just as I wouldn't simply show anything I have in my laptop to the first moron that I encounter while I walk to work

while the laws are on their side to inspect it.......from me they can inspect it /waste their time looking for stuff in a laptop that has nothing and will never have anything as long as I know that I have to cross borders

most random searches like these are totally useless as someone with a working brain can EASILY defeat this silly measures......

back to the Canadian goverment who is most famous for this nonsense........their croonies are totally defeated by any non-windows operating system......so if you want to laugh for a while install linux and see what happens when it boots without a GUI

I'd be quite surprised if Chuck Baldwin would be in favor of warrentless laptop, cell phone, mp3, etc. searches at airports or other borders.

The other reason is REAL change for a change instead of the same old BS from the Repubs & Dems both parties are broken & useless & owned by special interests most of the useless fucks don't listen to & are way out of touch with the people anymore

Even you are not such a lap dog to authority that you would permit government agents to search your person, home and private files without a warrant.
