Well here's my verdict

#1 Did sickgambler commit a crime?

A crime no, but being devious? definitely YES,
using the system to gain an advantage yes,
being technical, he was trying to "beat the system"
CONCLUSION on #1
The Gaming operations were set for Gamers to wager, whether they like the "odds" or not, the choice is there for them to wager or not. Point spead/odds/parlays/teasers/if's/RRobins etc etc
When you "look" at it,
The Good Gentleman has a "devious Mind" and IS trying to circumvent the due process of what the Books have to offer.
And therefore is
"Guilty of intent to defraud and manipulate by devious actions"
Should not be allowed to wager with other Books, he has a gambling problem and should be referred to Gamblers Anonymous, and further should be checked to see if he has try to deceive Friends/family etc.

#2 Should sickgambler be given his money back?
He should be given back the "POST UP FUNDS"
Nothing more , Nothing less

#3 Should sickgambler remain a poster at Rx?
Yes , he should be allowed to post.
But under a watch full eye.

Rather than repeating reasons why-Im in agreement with reasons previously expressed by JJGOLD and WIL and a those of (few posts back) by JudgeWapner(ret)

I almost see this somewhat akin to buying a palmpilot with 100$ rebate one per household and he fills out form (and buys) for his mother also and the company comes back and says no way same address(well, yes but he rents basement there)
I think he gets both rebates.

Somebody is lying either at Neteller or **** the Fraud is. I spoke to Neteller today and they said David does not work there any longer. The person wouldn't give me a reason why.

I don't have to lie about anything. I spoke to head of security at neteller today around 12:30 pm EST. The person said David doesn't work there anymore.
