(CBS) <!-- sphereit start--> There is talk in California of what you could call a radical idea for the cash-poor state to raise money. It's controversial, but proponents say the plan could smoke out more than a billion dollars for the state, as CBS News correspondent John Blackstone reports.

It is an unusual commercial: taxpayers demanding a new tax. It's an offer by marijuana users to help the state's battered budget.

"We're marijuana consumers. We want to pay our fair share."

It's estimated that $14 billion worth of marijuana is sold illegally in the state. Making it legal and taxing it at $50 dollars an ounce would bring in approximately $1.4 billion a year. Assemblyman Tom Ammiano has been pushing the idea.

"I thought it was high time - no pun intended - that this was on the table," he said.



As many see it, marijuana is already virtually legal in California where state law allows it for medical use.

At one Los Angeles dispensary, The Farmacy, the cannabis comes in buds so you can smoke it of course, but you don't have to. There's also cookies and candy bars, also drinks with cannabis as the active ingredient, and gelato - so you can take your medicine like ice cream or lollipops.

One dispensary gave out free pot to anyone with a valid prescription. The line was out the door.

While many doctors say marijuana has valid medical uses, like treating nausea in chemotherapy patients, critics say California's medical marijuana dispensaries sell the drug to almost anyone.

The following is a copy of a post I wrote a couple nights back within another thread.

FYI, possession of marijuana is legal in Alaska (up to 4 ozs in private residences). It is also legal to possess in 14 other states for those who qualify under state medical marijuana laws.

As to your mention, "the most people will do is complain on some forum and that's about it" belies the reality that all of the above was accomplished during the past 14 years by literally tens of thousands of Americans mobilizing the needed legal forces within their states. Many of the changed laws came via passage of ballot initiatives which were brought to the ballot thanks to the work of thousands of people within the respective state and then the votes of literally millions. Others were changed via their state legislature whose members were lobbied and motivated by, again, tens of thousands of constituents within the respective states.

In the coming 6 to 36 months, you can expect to see at least another half dozen U.S. states pass laws permitting legal possesion for medical marijuana and a similar number (or more) passing changes to current law that will decriminalize possession for all adults.

Barring a return to the White House of a Republican President in 2012, we can then look to see another half dozen or more states continue the trend during the 2013-2016 time frame. It's also quite likely that at least a few states will eliminate all criminal laws against adult possession and commercial distribution of marijuana. This latter forecast is based on the very sensible public comments made in support of such discussion by Arnold S in California and also the Governor of New York.

I'll add to it briefly by emphasizing that the driving force behind the dozens of changes to marijuana laws over the past 14 years has been citizens mobilizing and focusing their efforts via legitimate educational efforts (for media, policy makers and the electorate at large) and through legitimate lobbying and legislative channels.

I can direct anyone who is sincerely interested in contributing time and/or money to these ongoing legitimate efforts thanks to my own connections created during the past ten years working at a state and national level to reform failed public drug policies. Simply send me a PM and I'll show you how you can make a legitimate contribution without fear that your time/money will be frittered away by some person or organization that is not truly effecting real change in the laws.

i wouldn't mind it being legalized, but it'll be awhile before you can just walk in someplace and buy it. since i don't partake i wouldn't mind seeing them tax the shit out of it every time they want to rasie some cash. and after that, regulating it and putting added ingredients in it to keep people from burning themselves up, and reducing the chemicals that are considered to be hazardous and contribute to the effects.

then i can bust the balls of my non tobacco using, pot smoking buddies when they bitch about how they're constantly abused for being a potsmoker.

That's a model which can be easily emulated in combination with emulating current commercial distribution models for alcohol and OTC pharmaceuticals.

I take it you're not familiar with the common practice of mixing cannabis into food products? It's a common form of ingestion, delivers all the positive benefits and eliminates any of the hazards associated with inhaling the smoke of the burning plant.

Vaporization is done with a special tool (the vaporizer) which heats the plant product to a level just short of combustable and that's enough to produce a non-toxic vapor which can be inhaled and also delivers all the positive benefits.

nah, i was a daily smoker for 5 years, but haven't used it in 10. i smoked joints, bongs and pipes -- hell my brother taught me to make a pipe with the wrapper in a cigarette box -- but never ate it except for inhaling chunks while toking on my poorly rolled joints.

all the stuff you're talking about is new to me, although if i went back to my old ways i'm sure i could give you my own educated take on the subject in no time.

I did not cast a vote on the current wording of the Poll question because - as noted in my first post in this thread - marijuana is already legal to possess for upwards of 20million Americans, firmly decriminalized for another approximately 100million.

Legal distribution is taking place all across California and in numerous places within eight of the 13 other states with medical marijuana laws.

Other than the folks interested in cultivating and commercially distributing multi millions in volume per year, Max, I'm not aware of a single cannabis consumer in the USA who gives a shit how the federal laws read.

Most certainly, the faux cops at the DEA are not enforcing the federal laws against anyone handling less than a couple hundred pounds at a time.

And they've been called off of the state-legal medical marijuana providers by President Obama and his AG Eric Holder.

All in all, the federal laws prohibiting marijuana possession and distribution are a moot point for 99.9% of American cannabis consumers.

Distribution of greater than 5 grams of marijuana to a minor under the age of 21 doubles the possible penalties. Distribution within 1,000 feet of a school, playground, public housing or within 100 feet of a youth center, public pool or video arcade also doubles the possible penalties.
The sale of paraphernalia is punishable by up to three years in prison.
The sentence of death can be carried out on a defendant who has been found guilty of manufacturing, importing or distributing a controlled substance if the act was committed as part of a continuing criminal enterprise – but only if the defendant is (1) the principal administrator, organizer, or leader of the enterprise or is one of several such principal administrators, organizers, or leaders, and (2) the quantity of the controlled substance is 60,000 kilograms or more of a mixture or substance containing a detectable amount of marijuana, or 60,000 or more marijuana plants, or the if the enterprise received more than $20 million in gross receipts during any 12-month period of its existence.

Mandatory minimum sentence: When someone is convicted of an offense punishable by a mandatory minimum sentence, the judge must sentence the defendant to the mandatory minimum sentence or to a higher sentence. The judge has no power to sentence the defendant to less time than the mandatory minimum. A prisoner serving an MMS for a federal offense and for most state offenses will not be eligible for parole.
