NEW YORK (WABC) -- Former New York Giant Plaxico Burress pleaded guilty Thursday morning in a deal with prosecutors that will send him to prison for two years.
Burress pleaded guilty to on count of second-degree attempted criminal possession of a weapon. He will also be subject to two years post-prison supervision.
The deal, hammered out between prosecutors in the Manattan District Attorney's Offfice and Burress' lawyer, was the result of negotiations ongoing since his arrest last November.
Burress was indicted earlier this month on gun possession charges for accidentally shooting himself in the thigh in a nightclub.


During negotations, Burress' attorney was attempting to limit his client's prison time to a year behind bars. But the Manhattan District Attorney's office insisted on two years.
If Burress had been convicted of all charges, he could have faced 3 1/2 to 15 years in prison.

I think that sentence is BS. He should have gone to a jury trial.

I agree the sentence is BS. He had no intentions of commiting a crime. Government has way too much power in this instance. 2 years in prison is way too harsh. Why not fine the man a large sum of money instead.

Bloomberg is a hard ass mayor when it comes to gun crimes in NYC.
If he let Plax off with a hefty fine, the message would have been 'it's OK if you get busted with a gun, buy your way out, but if you are poor, do 2 to 5 years.'

This is one of those deals where you know what you are doing is illegal beforehand and still do it. No pity from me.

Firearms in NY is a big deal. I'm sure Plax new the type of penalty if he got caught. They have been hitting rappers for the past 7-8 years with these charges. The difference is Plax's case stuck because his dumbass accidentally discharged his.

Absolutely. Stallworth shit was a rip. Family didn't help by taking money in the civil suit so fast.

For him to only lose one season of football is insane. Plus the guy is at home watching NFL games on a theater screen placing wagers just like us instead of behind bars watching Regis through a caged tv screen.

I don't condone guns, but I cant say it is fair that Plax serves two years.

First, look at Paul Pierce and all the other athletes who have been attacked when they go out getting stabbed, shot, etc.

Can you really blame Plax for carrying a gun?

Vick and Stallworth did much much worse and yet Plaxico gets the worst sentence.....

Those NYC gun laws are a bitch.
If you feel like you need an illegal gun to go to a club in NYC, you are better off staying home.
Don't do the crime if you can't do the time, and Plax did the crime.

Prison time is mandatory by NY state law.

As for questions about "should have taken it to jury trial", you can be sure that the DA told him straight up that if you make me have to pay for the time and cost of a jury trial, I'll see to it that you get at least double the prison time.

And given there was virtually no way to defend in court the charge of "possessing a handgun", Burress was very smart to take the plea bargain.

The charge is not "shooting himself".

It is Possession of a handgun in NYC

The laws are sternly written and sternly enforced.

At an average cost of $30,000+ per year to house and legally care for a prison inmate, you would then be calling for you and me and your fellow taxpayers to underwrite $300,000 for each CFM. And last I looked around, there's an endless line of CFMs in most communities, eh?
