Phil Ivey countersues Borgata Casino over baccarat winnings

Professional gambler Phil Ivey is countersuing the Borgata Casino in New Jersey over nearly $10 million he won playing Baccarat in 2012 while using a high-level and controversial technique known as edge sorting.

The casino claims Ivey knowingly exploited a defect on the backs of cards from a deck he specifically requested, purple Gemaco, during four visits between April and October 2012. Playing under special conditions requested by Ivey and granted by the casino, he won $9.6 million.

After learning that Crockfords, a swanky London casino, had denied Ivey $12 million-plus in winnings over similar allegations, the Borgata filed suit in April 2014.

On Wednesday, attorneys for Ivey and co-defendants Cheng Yin Sun and Gemaco, the card manufacturer, filed a countersuit, claiming Borgata had destroyed the decks of cards in question. Further, the countersuit claims a representative of the casino acknowledged that the casino was aware playing cards have cutting "tolerances," that Ivey never touched the cards, and that granting the special requests of high rollers was not unusual.

"Plaintiff Borgata had a duty of care at all times relevant hereto due and owing to the defendants, to maintain, sequester and preserve the precise playing cards utilized by the plaintiff in each of the casino games patronized by the defendants from April through July of 2012," the countersuit states. "Plaintiff Borgata knew that those playing cards were critically material to Ivey and Sun's defense, and knew further that destruction of those playing cards would render the defendants irrevocably prejudice in defending against plaintiff's claims and in securing judgment against the plaintiff."

Ivey, through a spokesperson, offered no comment but has maintained his innocence throughout the Borgata and Crockfords cases. Last October, a High Court in London ruled in favor of Crockfords, allowing the casino to withhold 7.7 million pounds ($12.4 million) that Ivey won playing baccarat in August 2012.

"As I said in court, it's not in my nature to cheat -- and I would never do anything to risk my reputation," Ivey said in a statement after the October ruling. "I am pleased that the judge acknowledged in court that I was a truthful witness by saying that, 'I am entirely convinced that Mr. Ivey did not consider that what he was doing was cheating.'

"I believe that what we did was a legitimate strategy -- we did nothing more than exploit Crockfords' failure to take proper steps to protect themselves against a player of my ability -- clearly today, the judge did not agree."

Ivey has been granted an appeal that will be heard in December. When granting the appeal, Lord Justice Kim Lewison stated Ivey's grounds for appeal "raise an important question [of law] and have a real prospect of success."

When edge sorting, players look for designs on the back of the cards that are asymmetrical and use them to identify the value of the cards. At the Borgata, Ivey initially posted up $1 million in exchange for a private playing area, a dealer who spoke Mandarin Chinese, an automatic shuffler and one eight-deck shoe of purple Gemaco playing cards. The requests were granted.

Sun, a known professional gambler who, according to court documents, has been banned from several casinos around the world, sat with Ivey and communicated with the dealer in Mandarin, instructing her to turn the cards in certain directions before flipping them over. This allowed them to effectively sort the deck to better expose any asymmetrical flaws of the design on the back of the cards, without touching them.

Since Ivey never touched the cards, I can't see how the casino can win their lawsuit.

Casinos go to extreme lengths making excuses when a player beats them to a pulp over & over.

ivey's suit is quite interesting. NJ's laws are written for the house not the player. there
is no question he didn't cheat, but he did exploit a weakness and an obvious case of lack of
casino oversight, awareness, and supervisory/surveillance control. the trouble with
this case is that decisions are made by judges/juries who have NO CLUE as to what is right,
wrong, legal, or illegal in regards to casino gambling. by the time the lawyers and
expert witnesses for both sides have manipulated the facts and the law, ANY
DECISION IS POSSIBLE.

n recent legal documents filed by Phil Ivey in his edge sorting case initiated by theBorgata Hotel Casino, the 10-time WSOP gold bracelet winner claimed that the casino employs "pretty cocktail waitresses" in an attempt to distract and gain an edge over gamblers.





Ivey went on to say that those attractive waitresses, known as the Borgata Babes, are "all flirty" and that he "got quite a few [cell phone] numbers" while playing baccarat. His argument revolves around the premise that while the casino is aiming for an advantage by providing free alcohol served by the“scantilly-clad cocktail waitresses,” he is simply countering that maneuver by attempting to gain an advantage through edge sorting.

According to a recent appeals court decision in an unrelated case involving the Borgata Babes, it appears that Ivey's argument has a considerable amount of validity. It was recently revealed that the Borgata Babes must meet and maintain certain weight requirements in order to present an attractive and sexy appearance.



Apparently, a couple of those Borgata Babes failed to meet the prescribed weight standards and were fired as a result. They and almost two dozen other Borgata Babes filed a suit against the casino, claiming discrimination due to the weight requirements.

A New Jersey appeals court sided with the casino, stating that the Borgata has the right to apply standards related to physical appearance because male servers are subject to requirements as well. Plus, the Borgata Babes agree to the weight standards upon hiring, signing documents promising to do so.



The NJ appeals court recognized the Borgata Babes as "a specialized group of costumed beverage servers," according to g3newswire.com. And Ivey sees the slim and sexy ladies as a distraction aimed at gaining an advantage over he and other gamblers, prompting him to use a certain advantage at his disposable - edge sorting.

Ivey and his edge sorting pro companion, Cheng Yin Sun, were able to win millions despite the distraction caused by the free alcohol served by the sexy Borgata Babes. Perhaps the reason behind that is that Sun is also a member of the fairer sex, likely not as affected by the flirty behavior of the Borgata Babes as was Ivey. In any event, the ruling appears to back up Ivey's claim to some degree.



Ah, what a life Ivey has. Getting drunk and flirting with sexy cocktail waitresses while winning $9.6 million. And in addition to going home with millions, he has the phone numbers of the Borgata Babes, who would likely get all of his attention and focus outside of the casino.
