Parking Lot accidents

So tonight I was pulling out of my apartment parking lot stall slowly and some girl drills the back end of my truck. She says she didnt see me but I was half way through in the lane. I think she was texting. Who is at fault here.

I would figure you were. She was already in the lane. People backing out have to watch out for her.

FYI, I'm not a lawyer or cop or anything. Just my accepted rule of thumb. Could be wrong.

Since the accident occurred on private property (parking lots) it doesn't matter who is at fault. Your insurance will pay for your car and her insurance will pay for her car.

Not true. Although the accident occurred on private property you can still have the insurance company of the at fault driver pay for damages.

To answer the question of the op, you are at fault for "backing not in safety causing an accident."

If she wants to she can call her insurance company and they will come after you for damages.

The police will not come out to a private property such as a supermarket parking lot or parking structure in an apartment. So no police report can be of record. Unless one person admits fault to the accident no insurance company will pay for the other parties damages without a police report.

Your best bet is two have both you and the chick you got into the accident with just lie to your insurance company and say somebody hit your parked car and didn't leave a note. This way it saves your good driving rating.

Yes they will. I have been a cop for over 17 years and have made many accidents in parking lots. As a matter of fact, my wife was hit in a parking lot last year and the insurance company for the other driver paid for the damages.

In houston they will come to a parking lot accident in 4-5 hours after you report it. LOL You know it is ture Texans Fan admit it. In some states parking lot accidents on Private Property are no fault accidents. Insurance companies will try to get what ever they can when they think they can that is for sure.

I will say this hosnatcher, there are probably many departments that wouldn't show up. The Houston Police Dept however will show up for any call for service. Most departments will advise you to gather the info, drive to the nearest police station and fill out a blue form.

I'm in...He's right though for the most part. Like I stated, there are many dept's that won't come, but there are some that will. I would call them and see if they come out.

Like I said though, we had the at fault driver in my wife's accident pay for damages when she was hit in a private lot.

It must vary from county to county and state to state. I got in an accident years ago in a parking lot and the cops refused to come out because it took place in a Blockbuster Video parking lot. My car had far more damage then the other drivers car but he was cool enough to split the damages 50/50 on both of our estimates combined.

I also had my parked car hit by a neighbor before because she admitted fault (hitting a parked car can only be one persons fault) her insurance company took care of the damages.

Bullshit if they call it my fault. I was half way into the lane. I pulled out SLOW while looking back and there was NO car to be seen. There is a freaking 4 foot long gash from the from about a foot in front of her passenger door along the side of her car. She must have been flying.

Its funny when I think about all of the auto accidents I have been in over my life it makes you wonder how some of these people even have driver licenses at all. An accident is an accident, that is why it is called just that. But when somebody doesn't know who is at fault of the accident it can be comical at times.

One time I was driving on a busy residential street that dumps you off in a major street and there was about 3 cars ahead of me at a stop sign and 1 car behind me, we were all stopped. Well this guy (Asian) was backing out of driveway and he backed right into my stopped car. Well he was trying to say it wasn't his fault because I was stopped in the street. HUH?????

Then one time I was driving down a busy street and in my lane traffic was moving but in the lane to left of me traffic was pretty much stopped. So this one chick decides to dart in my lane so I ended up nailing her car. She tried to say she wasn't at fault because she signaled. I told her just because you flip on your turn signal doesn't mean that all cars on the road have to stop for you. You need to make sure you have a clear lane to enter in. We ended up calling the cops and the cop was literally laughing at her explanation of how it was my fault.

The only reason I am even asking is I have heard people get FUCKED in parking lot accidents, even whe they didnt do SHIT wrong as myself.

In Canada, Police only respond to accidents with injuries.

ALWAYS have a camera in your car(cell phone etc.)
Take photos from all angles!

People lie.

Years ago, I had just bought a new Saab 900 Turbo, and took it on
a road trip with some friends.

I stopped in a 7-11 in New Jersey, and stopped parallel to the store
to let people out of the car. Someone who was parked
perpendicular to the store backed right into the side of my Saab
without looking. Now keep in mind that I was completely stopped.

The insurance company ruled that I was 5% at fault because I
wasn't stopped in a parking spot. WTF?

So, I had to eat 5% of the damages.

I think generally the person backing out bears responsibility but if you were already out of your space and she just comes barreling through, then it's her fault of course.

I hope you used your Palm Pre to immediately take lots of pictures of both cars and the scene.

I was backing out slowly to the right no cars to be seen as I was half way in the lane she drilled my left bumper. She has a gash in her car that starts in front of her front passenger wheel all the way down the side to her rear passenger door.

I took alot of pics with the Pre. By the way the camera on that phone is by far better than any camera I have used on a cell.

Since you were backing you will be at least majority at fault if not 100% unfortunately. She may be negligent partially if can be proven she was speeding, going the wrong way or if she had last clear chance to avoid the accident...
