Just FYI,

If you do get relief from your credit card company, and you can prove that you are "insolvent", you will not be required to include the "forgiveness" as income for tax purposes.

IRS Form 982 is what you would fill out. Option 1b is what you would claim.

This is a little known tax form, but is very useful for those that need it. Otherwise, you will be required to pay ~30-35% of the "forgiveness" from the credit card company.

It always helps to know tax law. :toast:

If you send a cease and desist letter you run the risk of getting sued so be careful what you wish for.

Is this me pretty much saying "fuck you, leave me alone, you're not getting a dime?" Now I don't think not paying my debt is a good decision. I've brought this debt on I need to man up and pay it. But I have thought about this:lolBIG:

Would a company really go through the troubles of suing over a $900 balance?

Let me first start off by saying I am a partner on a mid-sized debt settlement firm.

I constantly work with people who have low and high credit card debt, you are nowhere near in the situation of needing help from a settlement company. First off, you don't have enough debt. $3300 dollars is so minimal, I know it may seem like a lot; but it really isn't.

Not all settlement companies do what they say they are going to do. I can tell you this, if you are already behind on these accounts, just let them go further back. When they get to collection companies, settle the debt yourself if that is what you need to do.

I am more than willing to do the negotiation for you at no cost if you would like me to. I will do it just to help out a fellow rx'er. Keep in mind that when you do this your accounts will say that they are settled on your credit report.

That is a better option than just not paying your bills and letting them go. Your debt is too low for any debt settlement firm to work on. Industry wide we have a minimum credit number of 5k.

Furms right - if the amount of the savings is greater than $600 on the settlement you should get a 1099-C from the bank (or debt buyer).

The other option - and i am NOT telling you to do this - is to "dispute" a portion of the debt and document how you are paying in full on the undisputed portion of the debt. That can also get you out of the tax consequences, i believe - but you're best to consult a tax guru on that one.

Most likely not. What they would probably do is sell the debt to another collection agency and you would be contacted by them. In which case, you should send another cease comm letter.

Do not fuck your credit up kid, 3500 is not a whole lot, just figure it out and pay it, if you stiff them this will haunt you forever

and im not the greatest at these things but just saying--if you do not do this right--10 years from now you will be making bank and kicking yourself because you cant the home loan you want or some shit--atleast not at a good rate

don't forget, with it being the new year you get a free glimpse at your 3 credit reports. i'd say, if your credit is already damaged -- say, into the poor rating area -- i wouldn't worry too much because it ain't gonna get much worse. but if you're still hanging around the fair to above average mark, then you certainly wanna protect it.

I understand it's nothing to most...but what I make at work covers my rent, groceries, and cell phone. I take 18 hours of courses.

I get called like 50 times a day so I do kinda sweat it. I'm just afraid if I let it get too far, considering I can't do the lump $200 up front they're looking for, I'm going to served or sued or some shit. But on the flip, I can't see a company going through all of that trouble for $1000.

Sooner, where can I see these for free one time? And what's "bad", "not bad,""good?"

i'm not sure the exact link, but google it. it's a consumer law that allows you to check your score with all 3 credit monitoring agencies once per year. don't fall for the free credit report dot com site. here you go....

i have a monthly subscription to experian for 5 bucks a month, they notify you when there's a change and what not. i destroyed my credit when i was younger -- repossession, charge offs (credit cards) -- and that shit takes time to work off. i have managed to get my credit back to around average, but it's taken about 3 years, and the score moves slowly. when you check your score, they will give you a rating with the score -- usually something like excellent, good, fair, poor, and very poor. if the stuff you have now has already affected your score to the point that it's dragged you down into the poor area, i'd say fuck it. 7 years and that shit goes off. i made the mistake of paying something that had been in collection, thinking by paying that it would help, but it didn't. it still showed as fucked on my report.

if your credit is still in the fair or better category, i would certainly try to protect it by working something out.

this is just me talking though. in no way do i claim to know what's best.

You can't SOMEHOW come up with $200? Cancel your cell phone, sell your cell phone (hell look around your place for shit to sell), donate plasma, eat Ramen Noodles for a couple months. Don't go out...

If you have a job, get another part time one. This isn't that much money, a little hard work and you can be out of debt easily by years end and not fuck up your credit.

There is no way I can do two jobs as well as all of my senior work to graduate in May. I could come up with $200, but it's $200 per, so it's like $600. I also live half a country away from family so I can't cancel phone.
