Something tells me if he was there top salesman he could have worn a packers tie, shirt, pants, and earings to.

Trust me, good salesmen are hard to find. If he was any good they would have kept him.

Unless they had a pre-existing dress code/policy, they will lose a lawsuit. Period. The tie was not vulger. There was no reason to him remove it. It was basically the manager's sour grapes. You can't fire someone because your favorite team lost. The dealership will get burned over this.

Now if the salesman threw an F-bomb or something along those lines, he could be screwed. Otherwise, the dealership loses here.

the place is a sponsor of the bears. and what good is wearing the tie going to do anyways. i dont think its the end of the world, but if your employer asks you to remove it repeatedly, just f'n do it.

1) The guy is a lifelong Packers fan and he's supporting his team...no big deal.
2) If he tells you he doesn't like your shirt (and it's an appropriate shirt) do you go home and change it?

If someone came in to buy a car and they saw his tie and because of that tie they went to a different dealer then they have a real big problem.

he will sue and he will win, and he should win.....i am a bears fan, but i am not a sore loser....i also am in sales and the tie would be a great attention getter. and from the interview he gave it was working. he said that the cust he had dealt with while wearing it, which was also in memory of his recently deceased grandma. the dealership will find out the hard way that being a poor sport will cost them in the long run.....it's just a tie.....

Alot of sore losers who are big bear fans would refuse to do business with the company solely because of that tie. That would result in profit lost for the company. If he sues he certainly won't win on that fact alone. The manager was doing what's best for the company, not because he had a personal vandetta against him or the Green Bay Packers.

After only a month and a half he was probably still on some sort of probationary period anyway, employers dont need justification to fire in this period since its for evaluation anyway.
