IRS agents testified before Congress that the agency’s political targeting did not apply to progressive groups as Democrats and the media have claimed, according to a bombshell new staff report prepared by the House Oversight Committee chairman, Rep. Darrell Issa.
IRS agents testified before Oversight that ACORN groups were scrutinized because the agency thought they were old organizations applying as new ones. Emerge America was scrutinized for potential “improper private benefit.” No evidence exists that the IRS requested additional information from any Occupy Wall Street group.
“Only seven applications in the IRS backlog contained the word ‘progressive,’ all of which were then approved by the IRS, while Tea Party groups received unprecedented review and experienced years-long delays. While some liberal-oriented groups were singled out for scrutiny, evidence shows it was due to non-political reasons,” according to the Oversight staff report, which was obtained by The Daily Caller.
“[T]he Administration and congressional Democrats have seized upon the notion that the IRS’s targeting was not just limited to conservative applicants,” the report states. “These Democratic claims are flat-out wrong and have no basis in any thorough examination of the facts. Yet, the Administration’s chief defenders continue to make these assertions in a concerted effort to deflect and distract from the truth about the IRS’s targeting of tax-exempt applicants.”
“[T]here is simply no evidence that any liberal or progressive group received enhanced scrutiny because its application reflected the organization’s political views,” the report stated

Even the article says that Progressive Groups were scrutinized, as were Tea Party groups, as they should have been. That'swhat the IRS is supposed to do. Misleading Title by a guy who lies. “These Democratic claims are flat-out wrong and have no basis in any thorough examination of the facts,” Rep. Darrell Issa (R-Calif.), the panel’s chairman, said in an executive summary of the findings.
Before the 2010 election, the IRS began using “be on the lookout” lists, or BOLOs, to screen for groups that might be involved in too much political activity to qualify for tax-exempt status. An inspector general’s report last year found that the agency inappropriately singled out applicants based on their names and policy positions.
Issa’s report, released Monday, revealed that all three of the IRS’s test cases involved conservative organizations — the Prescott Tea Party, the American Hunto and the Albuquerque Tea Party. Two of the groups dropped their applications as the review process dragged on, according to the findings.
The report also contends that “only tea party applicants received systematic scrutiny because of their political beliefs,” even though the IRS screened for progressive groups as well.
The last BOLO that the IRS created included only conservative-sounding names, but Democrats have pointed out that earlier lists, as well as certain IRS training materials, advised employees to screen for names associated with liberal causes as well.
The report downplays the screening of left-leaning groups, saying the IRS pulled them aside ”because of objective, non-political concerns, but not because of their political beliefs.”
Issa said the IRS only scrutinized affiliates of the Association of Community Organizers for Reform Now, known as ACORN, “out of concern that they were old organizations improperly applying as new ones.”
The chairman also said the IRS screened groups associated with Emerge America because “some had already been approved and the IRS became concerned about improper private benefit.”
The report highlights years-long delays that some conservative-leaning groups experienced as the IRS held up their applications. It noted that only seven organizations in the agency’s backlog contained the word “progressive,” and that the IRS ultimately approved those applications while tea party groups remained under review.
Rep. Elijah Cummings (D-Md.), the committee’s ranking Democrat, accused Issa of “cherry picking evidence and simply disregarding documents that directly contradict his partisan narrative.”

“Chairman Issa has in his possession — right now — IRS documents that show definitively that both progressive and conservative groups were highlighted for scrutiny,” Cummings said in a statement on Monday.
The release of the report on Monday came three days before the House oversight committee is scheduled to vote on whether to hold former IRS official Lois Lerner in contempt of Congress for refusing to testify about the agency’s targeting controversy.

Organizing For Action is, of course, the group founded by Team Obama in 2009 after he was sworn in to push his agenda while in office. It’s the successor to Obama For America, his 2008 campaign outfit. The first OFA got him elected, the second OFA is supposed to help get his policies through Congress.

Here’s who was running the scrupulously impartial IRS Exempt Organizations Division that targeted dozens of tea-party nonprofits for extra scrutiny.

That’s the juiciest bit released today by the House Ways and Means Committee, which voted — along party lines, natch — to send a criminal referral letter about Lerner’s IRS shenanigans to Eric Holder. They’ve also published a timeline of Lerner’s actions towards conservative groups based on the evidence gathered from their investigation. Note that she sent that e-mail about working for OFA just three weeks after she intervened in the review process to ask whether Crossroads GPS, an arm of Karl Rove’s American Crossroads, was being audited.

January 4, 2013:
Lerner Pressures Review Committee: Lerner inquires to the status of Crossroads, and finds that the group had not been selected for audit. She subsequently sent an email to the Director of Examinations in Dallas, TX, Nanette Downing, demanding to know why the group had not yet been audited. In her email to Downing, she notes that she wants all moves regarding Crossroads to be coordinated in DC. [See letter to DOJ]

That was done in the name of making sure that 501(c)(4) orgs weren’t spending impermissibly on political campaigns after the Supreme Court’s Citizens United decision. Oddly enough, though, only conservative 501(c)(4)s were of concern to Lerner; according to Ways and Means, she “turn[ed] a blind eye to similarly-organized liberal groups, like Priorities USA.” No wonder she thought of a job at OFA. She was working for O arguably as hard as they were.

“The IRS and the Oversight Minority made numerous requests for virtually identical information from True the Vote, raising concerns that the IRS improperly shared protected taxpayer information with Rep. Cummings’ staff,” a statement from the Oversight panel reads.
According to Issa, Cummings and his staff sought “copies of all training materials used for volunteers, affiliates, or other entities,” from True the Vote.
Five days after the Cummings inquiry, the IRS sent True the Vote an email requesting “a copy of [True the Vote’s] volunteer registration form,” “… the process you use to assign volunteers,” “how you keep your volunteers in teams,” and “how your volunteers are deployed … following the training they receive by you.”

BREAKING: House Votes for Criminal Charges for Lois Lerner


It’s finally happening. After months of lies, refusal to answer questions, and calls for her to be held in contempt, the House Ways and Means Committee has voted to refer Lois Lerner to the Department of Justice for possible criminal prosecution.
This vote was to refer Lerner to the DOJ for prosecution over the scandal itself, which violated multiple federal statutes and deprived conservatives of their First Amendment rights. Another House committee will vote tomorrow on whether to hold Lerner in contempt of Congress for her refusal to testify and multiple acts of lying.
House Republicans made their case against Lerner in a 14-page report addressed to Eric Holder. It is now the DOJ’s responsibility to act and hold her accountable.

Late last week, House Republicans pulled a Chris Christie and released their own report on the so-called "IRS scandal." Among their predictable conclusions: Of course the IRS picked on conservatives over liberals because the IRS is a liberal tool.
Issa is staging this for the benefit of the base, because he knows the one thing he does not want is for Lois Lerner to testify. Having boxed her in a corner, he's now using her choice to exercise her constitutional rights as reason to hold a kangaroo court vote. If she were to testify, she'd blow his entire case out of the water, so it's far better to render her silent and slapped.
The last person to do something like this was McCarthy, during the HUAC hearings. Huffington Post:
But there seems to a serious hitch in the drive to punish Lerner. According the records retrieved by the Congressional Research Service, no American has been successfully prosecuted for invoking their Fifth Amendment rights before Congress.
Congress brought contempt cases 11 times from 1951 to 1968, according the the CRS. Only two of those cases that involved documents -- not personal testimony -- were upheld by the courts.
Most of the cases involved the House Un-American Activities Committee and its communist witch-hunts in the 1950s. But one that is particularly instructive involves a Buffalo, N.Y., woman named Diantha Hoag, who was fired from her factory job after Sen. Joe McCarthy (R-Wis.) and his Senate Committee on Government Operations accused her of being a communist and she pleaded the Fifth.
That won't stop Issa. We live in times where precedent means nothing, where the end is far more desirable than the means, and where holding a government official in contempt for refusing to incriminate herself is just another day at the office.

GOP congressman and House Committee on Oversight and Government Reform chairman Darrell Issa’s quest to uncover the smoking gun of the IRS scandal story — the missing Gotcha! moment that will cause the Obama administration to crumble under the weight of its own corruption — has run aground lately, primarily due to the people in Issa’s cross hairs pleading the Fifth Amendment. But that doesn’t mean Issa is quite yet ready to give up.
According to a report in the Huffington Post, Issa and his allies are considering making a rare argument and a procedural move in order to force former IRS official Loris Lerner to testify. Lerner used to be the head of the IRS department tasked with figuring out whether to grant tax-exempt status to groups claiming to be apolitical in nature and focused primarily on “social welfare.” Republicans have charged that the IRS disproportionately targeted right-wing organizations for review. Lerner resigned and has spoken to Issa’s committee, but has also refused to answer some questions by pleading the Fifth.
In response to Lerner’s invocation of this constitutional right, Issa is now arguing that because the former government official did speak with the committee before pleading the Fifth, she waived her right to do so and is thus eligible to be held in contempt of Congress and even possibly face criminal charges. A report by the Congressional Research Services that is pushing Issa’s argument calls Lerner “critical to the Committee’s investigation[.]” Further, the report states that “Without [Lerner's] testimony, the full extent of the IRS’s targeting of Tea Party applications cannot be known, and the Committee will be unable to fully complete its work.”
One potential problem with Issa’s latest move, however, is the fact that no American has ever been successfully prosecuted for pleading the Fifth before Congress. Indeed, even the attempt to prosecute on such grounds is rare, with most of the examples in recent history having occurred during the McCarthyite years of the 1950s.

In that case, Hoag answered many more questions than Lerner did. She listed several places where she had lived, said she worked at a Westinghouse plant, and told committee members that she knew Westinghouse contracted with the military. Lerner never went beyond a short opening statement professing her innocence.
Hoag flatly refused to answer questions about her associates and any communist connections she may have had.
When McCarthy attempted to compel her testimony through the courts, as Issa is now threatening, a judge did not look kindly on the bid, declaring: “I reach the conclusion that the defendant did not waive her privilege under the Fifth Amendment and therefore did not violate the statute in question in refusing to answer the questions propounded to her. Therefore, I find that she is entitled to a judgment of acquittal on all counts.”

God forbid Issa tries to do his job, like Obama is not all about politics. So Issa plays their game and they cry like the babies they are. As long as Holder is AG then the entire administration knows they have a blank slate to do what ever they want.

Even worse he feels sorry for Cummings, LOL. Poor guy, Mr. Rant & Rave himself. Can't stand to be under anyone's leadership much like Issa's. Yes the most transparent administration ever continues to walk around with their flys down (in Lerner's case with her dress up in the air). LaLa land USA.
