What an irresponsible disorganized failure of a tax preparer!

He had my tax paperwork for a month and a half didn't even look at it.

I met with him on two occasions and he yeah yeah-ed me. He assured me he would get things done. He did nothing! My calls all went un-returned.

That is downright malpractice and if he was worth anything I would take legal action.

We had an agreement for him to file my return and he decided my returns were not as important as his trip to Aruba or watching the NCAA basketball tournament.

Then on April 6 I was told he needed bypass surgery and he was putting all his clients on extension.

That would've been a great excuse but he had my paperwork since February 6 and did nothing with it.

You are better off with H&R Block they make less excuses for their incompetence.

Stay away unless you want to be scrambling for a new tax preparer like the situation he put me in.

he also filed complaints with the BBB and other organizations (they were simply dismissed)

he threatened to suit me if I didn't offer him money


my crime against this man? I didn't complete his tax return before I had a heart attack at 3 AM on April 1st and bypass surgery on April 3rd

I'm going to post copies of whatever correspondence I can find, if only so you can laugh, but here's a rundown of what happened.

1) I met him sometime in February, although I'm fairly certain it was not 2/6. It was a 5 minute introduction and we talked standing in my reception area. He was meeting with a tax attorney I network with, the attorney walked him over to my office and asked me to take him on as a client. I said I would, because the attorney and I work closely together. The "new client" was the insurance agent for the tax attorney, owns a couple of businesses

2) we had a formal meeting on Saturday March 14th, going through his stuff. I gave him a homework assignment, an extended list of documents and records I needed.

3) he emailed everything to me on Monday, March 16, I still have this email saved just in case he should be stupid enough to pursue litigation.

4) so when he says I had his information since February 6, he's lying, I had it since March 16.

5) he says I went to Aruba instead of filing his return. If I did, so what, but I didn't, I never vacation during tax season. He's lying again

6) he says I'd rather watch the NCAA tournament, that's accurate. Everyone knows I'm a UConn season ticket holder and college hoops fan, I work around college basketball because I can. He knew this stuff when he hired me.

7) he was a new client that owned multiple businesses, not a situation conducive to completing a job quickly. I didn't do any preliminary work before tax season like I do all my business accounts, he walked in at the worst possible time with no groundwork and me not being familiar with his books. It's a learning curve with new clients, it can't be rushed.

8) I stop taking appointments April 1st, my plan was to work on his job the beginning of April when I can give it some extended undivided attention, it's what was required in such a situation.

9) My last day of work was March 31, not sure the timing could have been worse for a person in my profession. But it all worked out great, I even lost this asshole before I got to know him.

10) we spent < 1 hour together, I never billed him a penny

It is definitely a different world with the internet. Something like that is the downside of it, anyone can throw mud against the wall if they feel like it.

Would've been way cooler if Willie was like "Yeah Vitterd, I know who that is. Sent some goons to break his legs, it's a non-issue now."

Firstly please know Ihope your health is improving.

As I am sure you are aware I am disappointed that you never did any work on my tax return to the point I had to pick up my documents and have another preparer work on it. We had a verbal agreement for you to prepare my tax returns and you have failed to perform. There are consequences to your failure to perform as though I understand you had health issues on April 3,that is no excuse for not even beginning to work on my return between February 11 and April 3. You putting zero effort into beginning to prepare my return was made clear by the envelope I mailed you was still sealed with the original packing tape I used. Your failure has caused additional expenses to my business and I and I am holding you responsible for this.

I am reaching out to you based on the suggestion of our mutual acquaintance who referred me to you Attorney ...... If not for .....suggestion and your business relationship with ...I would have already filed my Code of Conduct and Ethics complaints against you with the Connecticut Board of Accountancy, AICPA and CTCPA a s well as pursuing this issue in the civil court system.

Ibrought you my tax return information on February 11. I personally met with you. You assured me you could complete my returns in the midst of your trip to Aruba and the NCAA basketball tournament.

I called your office several times between February 11 and April 3 and was told by a female that you did not get to my returns yet. I was contacted by ....on April 3 and told of your health condition. I called the following Monday and I was told about your medical procedure and that you were putting everyone on extension.

I decided because you had never reached out to me once or touched my file that I would not have you prepare my returns.

As mentioned above this is a professional courtesy notice requesting that you should contact me and offer a settlement before I contact the State Board of Accountancy and other organizations to pursue action against you. I may be willing to consider a settlement and sign a non-disclosure agreement regarding your misconduct . You have until May 15th to contact me.

Yeah I switched tax preparers a few years back. It took about two weeks of phone calls, information gathering, additional documents, W-2s for my employees, my financial guys info, etc etc...
And I still missed several write offs due to my former accountant not being there to remind me about certain write offs that were automatic with my former.
I basically run a small business with 3-4 full time employees and 6-8 1099 contract workers.
The amount of time, paperwork and effort it took w my new tax guy was 10 fold with my small operation, just due to un familiarity. Cant imagine what a new client with a sophisticated book of business would be like.

Here is his attempt at coercion, 27 days after surgery, a few points of emphasis

1) he changed our first meeting from 2/6 to 2/11, which is more plausible. He lied in his on-line complaint

2) he's still lying about me having his records on 2/11. I have an e-mail dated 3/16 which states he mailed me a flash drive with his QuickBooks backup, and I should have it shortly. When he says I didn't open his mail, that's what he's talking about. I never do a job piecemeal, so not opening and looking at documents is not uncommon, it's simply not efficient to do so for me. until I'm ready to work on it.

3) while in his Google complaint he says I never returned his calls, in this letter he acknowledges always speaking to somebody, and he acknowledges that somebody always told him the truth, "I didn't work on his account yet" (my best guess is that I told him I'd be working on it in April, I'm always upfront about that kind of stuff.

4) while he's threatening me on April 30th, he wrote his review on April 15th

5) he pretty much confirms everything else I said in one way or another




PS: I never heard from him after this letter, and I never responded to this letter

there's a learning curve, it can't be rushed unless the tax professional simply doesn't care about details

I would have taken care of him with reduced fees too, just like I did for many people last year
