MIAMI BEACH, Fla. (WSVN) -- The man who was left in a medically-induced coma after being struck by a customer at a South Florida convenience store, succumbed to his injuries over the weekend.
Police said, 58-year-old Muhammed Hussein was knocked unconscious by 53-year-old Roger Perry back on Dec. 1.
Surveillance cameras at the M&L Food Market in Miami Beach, captured the physical altercation after Hussein became irritated with Perry for cutting in line in front of him.
Hussein suffered brain hemorrhaging and was transported to Jackson Memorial Hospital where he was in a coma for three days.
Perry fled the scene but was arrested and taken to Miami-Dade County Jail. He was initially charged with felony battery but his charges have now been upgraded to second-degree murder.
"There is no allegation of any types of weapons being utilized," said Perry's attorney who asked the judge to lower the charge to manslaughter. "There's no allegation of anything other than a single strike using a backhand that unfortunately resulted in the alleged victim falling and striking his head."
Perry is set to appear at a probable cause hearing Wednesday.
