A federal appeals court said Tuesday it would not resurrect a lawsuit that former CIA operative Valerie Plame brought against members of the Bush administration.

Plame accused Vice President Dick Cheney and several former high-ranking administration officials of revealing her identity to reporters in 2003. She and her husband, former Ambassador Joseph Wilson, say that violated their constitutional rights.

It was an unusual case and even some on Plame's legal team acknowledged the case was an uphill fight from the start.

A federal judge dismissed the case last year and the U.S. Court of Appeals for the District of Columbia Circuit upheld that ruling Tuesday. The appeals court said that Plame and Wilson did not meet the legal standard for constitutional claims, in part because the lawsuit hinges on alleged violations of the Privacy Act — a law that does not cover the president or the vice president's offices.

tizdoom, we have the most leverage of any nation. Sometimes allowing a third party to intervene is a way to "save face". Don't know what's going on behind the scenes, but neither do you.

The court certainly didn't say the accusations were lies. All it apparently said was that the the Prez and VP are not subject to the Privacy Act.

How is D2's interpretation "generous?" I think it is a literal interpretation of what happened.

Why is it a generous interpretation? Because the court ruling is 42 pages long, and that tiny little phrase "in part due to" should open your eyes just a tad.

How about:

The district court held that the invasion of privacy claim
also required dismissal. The United States had intervened in the
lawsuit with respect to the tort claim and had filed a certification
pursuant to the Westfall Act, 28 U.S.C. § 2679(d)(2), that, “at
the time of the conduct alleged in the amended complaint the
individual federal defendants . . . were each acting within the
scope of their employment as employees of the United States.”

The court found that the Westfall Act certification was proper,
meaning that the case must proceed solely against the United
States under the Federal Tort Claims Act (“FTCA”), 28 U.S.C.
§§ 2671–80. Because the Wilsons had not exhausted
administrative remedies as required by the FTCA, the court
dismissed the claim for lack of jurisdiction. The Wilsons
appealed.

that's right, the Wilson's initiated a political attack (which was weak and full of holes) and the President's office is expected to respond to such political attack.

Of course, the fact that no laws were broken is releasing her name had been settled some time ago.

This was an obvious set up deal...and the media played along. The political damage of the accusations were always much more important than being found to be a bunch of scum bag liars later.

It doesn't take a rocket scientist to see how this works.

The media will just drop it and forget it like it never happened.

They all got what they wanted...juicy headlines to slam Bush in the heat of the Iraq war. It was all part of the media onslaught at the time to sway public opinion.

They should be taken out and shot...Val and her big fat scum bag hubby...and a few NY Times Reporters for good measure.

Bubba had to settle sexual predator litigation out of court, so I guess even the POTUS can be subject to a lawsuit, when they break the fucking law.
