Not only did he have his appeal for the $12m in winnings he was refused by Crockfords, London turned down by a London appellate court last month, but now he has been ordered to pay $10.1m to the Borgata Casino and Hotel in Atlantic City after a court ruling.[/FONT]
[FONT=&quot]Back in October a court in New Jersey ruled that the $9.6 million he gained during a session of mini-baccarat at the Borgata was irregular and he had breached his contract with the casino. Since then the Borgata filed a huge claim for damages which included not only the $9.6m Ivey "won" alongside accomplice Cheng Yin Sun but also for the $15.5m they claim they could have expected to have won from Ivey given the true house edge. Borgata also brought a case of fraud before the court. Although the $15.5m in damages were turned down as being "too speculative", and the fraud charges were dismissed, the court still ordered Ivey to pay back an eight-figure sum due to the fact that he subverted the true nature of the game. The judge ruled that the house's edge was one of the defining characteristics of baccarat, and by shifting the odds in his favour by using slight flaws in the cards patterns to determine their value, Ivey and Sun were in effect playing a different game, and one which was not regulated by the New Jersey Casino Control Act.[/FONT]
[FONT=&quot]The $10.1m payment is for the $9.6m Ivey won at baccarat and a further $504,000 Ivey won at craps while betting with the money he had made from Baccarat.[/FONT]
[FONT=&quot]On the bright side, the $1/2m in comps received by Ivey and Sun will not have to be repaid.[/FONT]
[FONT=&quot]It is unknown as yet whether Ivey will appeal this verdict, although given that he is currently appealing the the UK Supreme Court in the Crockfords case, we would be surprised if he will be ready to pay back the 10 milly just yet.[/FONT]

So if a BJ dealer mispays or doesn't burn a card properly, or a craps dealer incorrectly places a bet or pays at the wrong odds, a player can say if he would have won that money he would have quit and not continued to chase and lose the amount he did afterward? Didn't think so

Surprising, Yes, along the lines of thought you brought and potential precedent that they manage to get included that 504K

Of Course he is gonna Appeal tho. Ivey's Life Story when told in Movie Form is gonna be interesting as hell, massively +EV on the entertainment front.

I think the whole decision is BS. All the money should be Ivey's to keep.

He exploited Vulnerabilities. He orchestrated a means of profiting by simply taking advantage of avenues the Casinos made available to him.


Hell Yes he should be able to keep the money. Casinos Profit via The Exact Same means:

Exploiting Vulnerabilities of Humans and taking best advantage as they can of avenues to get people's money.

Highly doubt that

First of all, interest rates have been dog shit for those 4.5 and he would have made like 20k which he wipes his ass with daily

Second, these poker players and gamblers don't deposit in bank accounts or invest the money in mutual funds. If they did that, the IRS would be all over them. Their banks are casino cages, and their investments are their next bet.

gambling decisions while being influenced by lawyers and large corporations.
it seems that scenarios such as this and others (for example slot machine malfunctions)
should be decided by the local gaming commission and with the right to appeal
to binding arbitration. the arbitration board should consist of three members.
selected from a pool. one should be selected by the casino, the second by the player, and the third
either randomly or by the gaming commission. the arbitration board's decision should be
final and non-appealable. this will cut down on the wasted time and expense of using
the courts, make for better decisions, and take gambling decisions away from our courts
who are obviously way overmatched here. in the old days, john scarne, would of been perfect
in this role. the first name that comes to mind is sklansky. i'm sure there are others.

For as smart and clever as Ivy - how could he not know the story of the Golden Goose? Square # 1 is how much can I win without exposing my edge? He actually needed to lose some back and conclude the session-cards turned cold,etc.
