You and your buddy are talking about a game over the phone and come up with the same team. He only has two outs and you have five. One of your outs has the best line and of course you want to get the best line for both of you so you agree to bet it for him.

WELL GUESS WHAT IN MOST STATES YOU HAVE BROKEN THE LAW BECAUSE YOU HAVE PLACED A WAGER FOR SOMEONE OTHER THEN YOURSELF.

This is now happening to a friend of mine and it is sickening.

He is being charged with
PROMOTING GAMBLING AND
CONSPIRACY

Uh yeah, technically it is illegal, but I have to join the chorus and wonder how could he get caught unless the line was tapped or the guy who placed the bet squealed.

He leads a very nice lifestyle and has been gambling for 30 years. He and his wife have very high paying jobs(which his in now in jeapardy because the friend works with him)and someone obviously ratted him out and said he was a bookmaker which he is 100% not.(WHICH THEY NOW KNOW) So that is the charges they have come up with. Especially because the friend lives in another state even though it is only 22 miles away it is something like crossing state lines.

Sounds like they are fishing for any chance to dust off the Wire Act. If he can prove he isn't in the business it sounds like a probationary plea bargain, but then again who knows with ASScroft and his bulldogs in the DOJ.

Maybe message was picked up on a scanner. Any cell/cordless phone is easily picked up. Nowadays most folks only have one phone with a wire, for when power is out.

Information gleaned from a scanner isn't legally admissable evidence without prior search warrants. The message would have to have been taped and there would have been probable cause that criminal activity was going to take place on the line. For those reasons I highly doubt this was the cause.

Frankie, it might be illegal if the Gov wants it to be. i.e. if you have the br & time you can possibly beat it. I'm using the original Computer Group as my info source. Dr M, JK & BW got busted but BW claimed he/they were just betting for others not bookmaking. The calls they got were to move money and not book. BW finally wore them out. He kept getting the "case" thrown out and the Gov kept indicting him again. Finally after 3-4 tries they quit. Moral: They would probably get you or me if they wanted us.....ScottyS
