$1000 Per Day Fine And 30 Days In Jail For Refusing The Swine Flu Vaccine In Massachusetts?
<SMALL>BirdFlu Pandemic ^ | August 26, 2009 </SMALL>

A new law just passed in Massachusetts imposes fines of up to $1000 per day and up to a 30 day jail sentence for not obeying authorities during a public health emergency. So if you are instructed to take the swine flu vaccine in Massachusetts and you refuse, you could be facing fines that will bankrupt you and a prison sentence on top of that.
The YouTube video below is of a news report about this disturbing new law. In particular, pay attention at the 1:40 mark when the anchor and reporter discuss the new penalties for not obeying the health authorities during an emergency.....

If you have not realized it yet, the controversy over swine flu vaccinations is about to get very, very real. The authorities know that a lot of people are extremely concerned about the safety of the swine flu vaccine, and they are putting the infrastructure in place to deal with those dissenters. Let us hope that the worst case scenario with the swine flu does not take place, but the reality is that health authorities across the United States are gearing up for the biggest vaccination campaign in the nation's history. It looks like this fall could be very, very interesting.

Um actually it is *not* imaginary. The video clearly stated that people
that refuse to be quarantined could face $1K per day fines as well
as 30 day prison sentences.

That was the interpretation presented by the on scene reporter, yes.

But I'll invite you to relax (in case you were unduly concerned)

Solid case law at the federal level would impede any attempt by a government agency to inject medications into a citizen without their consent.

Here's a complete summary of the mandates within the bill. Failure to comply with any of the cited mandates is what would trigger the designated penalties.

There is no mandate that citizens would be compelled to receive a vaccination.

---------------
The bill specifically mandates the following:

(1) to require the owner or occupier of premises to permit entry into and investigation of the premises;
(2) to close, direct, and compel the evacuation of, or to decontaminate or cause to be decontaminated any building or facility, and to allow the reopening of the building or facility when the danger has ended;
(3) to decontaminate or cause to be decontaminated, or to destroy any material;
(4) to restrict or prohibit assemblages of persons;
(5) to require a health care facility to provide services or the use of its facility, or to transfer the management and supervision of the health care facility to the department or to a local public health authority;
(6) to control ingress to and egress from any stricken or threatened public area, and the movement of persons and materials within the area;
(7) to adopt and enforce measures to provide for the safe disposal of infectious waste and human remains, provided that religious, cultural, family, and individual beliefs of the deceased person shall be followed to the extent possible when disposing of human remains, whenever that may be done without endangering the public health;
(8) to procure, take immediate possession from any source, store, or distribute any anti-toxins, serums, vaccines, immunizing agents, antibiotics, and other pharmaceutical agents or medical supplies located within the commonwealth as may be necessary to respond to the emergency;
(9) to require in-state health care providers to assist in the performance of vaccination, treatment, examination, or testing of any individual as a condition of licensure, authorization, or the ability to continue to function as a health care provider in the commonwealth

Any person who knowingly violates an order of the commissioner or his or her designee, or of a local public health authority or its designee, given to effectuate the purposes of this subsection shall be punished by imprisonment for not more than 6 months, or by a fine of note more than one thousand dollars, or both.

I will also stand by my earlier post where I suggested this forum could benefit from a few more German-speaking members.

(<)< I was not questioning your post. It just seemed so preposterous.

No problem Dave.Glad to provide it for you.You see in the land of Massghanastan anything is possible.Actual law here in Mass. looks like the "Onion" on steroids.
One of my favorites is giving cars to welfare recipients that includes a gas card,insurance and repairs.
Nothing like going for a sunday drive down the Mass pike with someone in a free state car that can't read road signs in english.

But if you ever make it to Massghanistan.Keep this little reminder with you if are taken in for "your shots"....( I'm just worried about "free showers" since I heard they might lowering the "counseling" age because of Obama and Patricks "youth movement."

Although this will create riots and massive violence and discontent, notwithstanding the leaked letters in the British news regarding Guillan Barre Syndrome and this vaccine, there is a way to address such an order using the maxims of law.
In other words, never refuse what is presented as an apparent “order.” When you refuse you are in dishonor. This is still a voluntary universe. If ordered to take a vaccine, insist that the judge have the order in writing and that he must assume full responsibility for any adverse reaction/injury/death as a result of this command. The one making the demand upon the person despite the lack of a contract or agreement otherwise, must assume full responsibility as the person upon which the demand is being made becomes a ward of the moving party. Watch what happens. I might also throw in the Nuremburg Code regarding forced medical procedure or prophylaxis in my conditional counter-offer to receive the vaccine.

Overall, it appears to be a sensible preparation for a public health disaster.

What it clearly is not - a mandate that citizens be forcibly injected by the state or face criminal penalties.

I dont think its going to get down to dragging people in for flu shots this flu season anyway but we'll see.... I guess the taxpaying producers,kids & seniors should be first in line..Slackers & leeches last.
