How to go about taking Legal Action on a TOUT

I got picks by e-mail and sent money via western union. He sent picks, but lied about the service consistently, gave false picks, and denied service for undisclosed reasons...what and how can i take legal action against someone like this? What law is he breaking?

you have to be kidding me. Why not just call the irs as well and tell them that you want to claim your gambling winnings as well.

Just chalk it up as a lesson learned.....

A class action suit was just dismissed against a service and it had almost 40 clients and they were suing the service, radio stations and an offshore book. The tout service had already had all the employees plea guilty to violation of the wire wager act and the case still had no legs.

What do you mean? I DO have a case. He's denying me service. He hasn't answered his phone and stopped giving me plays...


Basicly, I guess you are looking for a "breach-of-contract" or to sue for return of funds for "paid services contract" which was not performed?
Either way ... you probably wont be able to prove a case.

It's called "being SCAMMED" and it's done everyday to lots of folks.
courts will NOT hear any case that starts with illegal gains!
which .. in time,will come to be,,in your case.
(as you were using the info for illegal betting)

I't kinda like telling a Judge, I got this e-mail that said I won the over-seas lottery ... and I sent them the front-money,but I never received my $10,000,000.00 ,,, it's just common sense law.

and don't laugh at the TV Judge etc.,too fast, it may be your best and least costly stab at trying to get your $$$ back.

It may make it to a show ... and you will get a free trip to NYC,and win or lose ... you will get paid an appearence-fee.

Yeah, I think you'd proceed on a breach of contract theory, not negligence. Duty/breach/causation/damages are the elements for a negligence cause of action, but I don't think that applies here because the tout intentionally chose to not honor the contract.

hey Witty...about six years ago, my brother in law was on Judge Joe Brown

Gave a friend some baseball collectables to sell on consignment and the guy didn't pay him.

Sued for $500 and prevailed.

Classic VHS videotape, especially the post-court interview scene where it becomes so painstakingly clear how foolish he feels for even having gone through the whole TV show.
