We purchased a liftchair wed. nov.25th for my wife[56yrs old] who suffers from adult scoliosis & other health issues & spends her 24hrs a day in a recliner as she cannot lay flat in a bed.She is able to walk w cane/walker [she is bent over at the waist] at a very slow pace but other than that she spends her time in the recliner.
The liftchair made of leatherette has caused her butt to become very sore as there seems to be a hard spot under the cushion where she sits. We called the salesman/owner 5 days after the purchase [due to holiday weekend] who came to the house to sell us the chair & told him of her problem & he told us to go purchase a memory foam cushion to give her more padding, so I went & got a 5 inch memory foam pillow & added another pillow on top of that & now she is sitting almost even with the armrests almost to the point of falling off the chair & is very uncomfortable & in more pain than when we purchased the lift chair.
When we purchased the chair, he agreed not to run the charge until after Dec. 5th due to a 1.99% promotion rate on our cc, but asked me for a check for $1300 that he would hold until charge was put through. Well after getting the pillow as he told us to do & saw that wasn't doing my wife any good, I called him at the store & the receptionist/secy said that he was out or busy. Well after about 2-3 attempts to reach him & after he's not calling me back as the secy said he would. I told her not to run the charge[now Dec.7th] & to come and get the chair & she went on to say that the salesman/owner said that he told us that there are no returns. This never was mentioned at anytime to us during his presentation to us.
I then called my bank & put a stop payment on the $1300 check & called the CC company who said it had not been posted at this time & notified them of what was going on & they went on to say, to dispute the charge if it comes through. I told the secy at about 12 noon not to put the charge through & found out later that day it was put through at 2:16PM about 2 hrs after i told her not. I then called the store & secy said the salesman/owner said to run the charge through. We called the cc company & disputed the charge as defective merchandise, they sent a letter to the merchant notifying him of the disputed charge.
This is now Dec 17th! We disputed the charge Dec. 7th. The store will not come & pick up the chair. OH ALMOST FORGOT, THE LIFTCHAIR WAS A FLOOR MODEL & he would not give us a discount. (He had us over a barell as the old chairs reclining handle broke & my wife had no chair to sit/sleep in & he knew that.) I have since researched this chair online & it sells for around $800 at several places.
I hope you can understand this garble or whatever you want to call it but excuse me as I am 71yrs old & trying to take care of my wife the best I can & am not that educated when it comes to English language.
HELP, What should can I do. Will he sue us in small claims court as the chair is just sitting here & he has not received any money as the cc company gave us a temporary credit on the acct for the chair, & he will not pick up the chair.
