KATY, Texas -- A dispute over a transgender child in Katy has become a nationwide controversy after two day care workers were fired, claiming it was because they refused to call a six-year-old child by a male name, when the parents of that child, who was born a girl, suddenly announced the child had transitioned.
Andy Taylor, the attorney for the two women, called this “a test case of nationwide significance” after he says two former workers were fired from this day care because of their beliefs. However, a spokesperson for the daycare’s corporation suggests the recent controversy around Houston’s Equal Rights Ordinance is helping turn what would normally be a routine personnel issue into a nationwide talking point.
“I just felt like I had to stand up to protect the 6 year olds,” said Madeline Kirksey, an employee with the Children's Lighthouse Learning Center on Clay Road in Katy.
But Kirksey and co-worker Akesha Wyatt say taking a stand cost them their jobs.
“I feel like it’s unfair personally,” Wyatt said.
“I have nothing against anyone else. I just think we all have a right,” Kirksey said. “We should be able to stand up for our rights without being terminated for it.”
Now Kirksey is filing a formal complaint with the EEOC for wrongful termination based on race, sex, age and religion. She says she was fired after she refused to go along with the sudden claims from a pair of same-sex parents that their 6-year-old child, who had been identified as a girl during the previous four months, suddenly be identified as a boy and called a boy’s name.
“I think at her age, she was indecisive,” Kirksey said. “Some days she wanted to be a girl, some days she wanted to be a boy.”
But Kirksey says besides her religious beliefs and concern that parents hadn’t been notified, she also worried that child would be bullied and classmates would be confused.
“This school handled this in a terrible manner,” Taylor said. “This case, we hope, will serve as a deterrent.”
Taylor also claims the school came up with unrelated excuses to fire Kirksey and struck out references to the transgender issue in her employment file.
The battle over transgender issues is nothing new to Taylor, who fought the now-repealed Houston Equal Rights Ordinance in court.
“There’s not a news story here, there’s someone with an agenda, and that’s what’s happened,” said Jamie Izaks, spokesperson for the corporate office Children’s Lighthouse Learning Centers.
Izaks told KHOU he thinks the recent controversy surrounding HERO and the spotlight on transgender issues could be fueling the fire of the controversy.
“This is happening in the crosshairs of a pretty heated discussion in Houston that has nothing to do with a school and its students,” Izaks said.
Izaks said the corporate office does not discuss employment matters of independently owned and operated franchise locations like the one on Clay Road.
Taylor says this EEOC filing is just the first step toward federal court. He told KHOU there could be further legal action by January.
