A lawyer cannot proceed without his clients approval. If Crunch wanted to settle his lawyer would have settled. He admitted he was told he could expect 5 figures. He wanted the big money, otherwise he would have taken the settlement and walked away knowing he was in the right.

I'm going to be 100% honest. Your lawyer sounds kind of like an idiot.

First of all a Lawyer is never ever, suppose to tell you he can get something. If he says that he is at a point where he is almost promising you something, and if he doesn't come threw he can be held liable so I am pretty sure he didn't say that.

Also a Lawyer is not even suppose to say I can beat these guys. He is suppose to tell you your options. Such as, you can accept the 2k and be guaranteed some money, or you can risk it and have the possibility of making more money but you could also lose money. Say then you ask him "What are my chances." He should tell you well looking at the facts you may have a case but there are no guarantees in the judicial system. The decision is yours. I can only work after your decision is made.

i'm sure no lawyer is dumb enough to guarantee a W in the courtoom. Sounds like crunch misinterpreted what his lawyer told him or was overconfident in his case. Understandable, you go over your own case again and again, you're bound to fall in love with it...hence the beauty of getting multiple perspectives from others. 2 heads are better than 1, 3 heads are better than 2, etc.

You're basically stating what everyone knows a lawyer is supposed to do.

Oh I completely agree... Everyone accept Crunch. I was saying what I was told by my dad when I got a reckless driving Bullshit ticket. They offered me a bargain at 550 plus 18 months probation. I had a print out saying my car couldn't go that fast but told me that if we took it to court, even a judge only court, that if I lost I would be paying over 1200 and possibly have my license taken. FAR FROM AS SEVERE AS CRUNCH I KNOW... but it is more about the fact that a Lawyer should ALWAYS review the bad... and I mean ALWAYS because if he doesn't there is a chance he can be held liable... That is why if his Lawyer really did these things he should seek legal advice elsewhere about pursuing something against his own lawyer.

Dude, you got problems, but your life is not over. Far from it. Your problem is big, but not as big as you make it. You will realize this later. As they say "This too shall pass."

I had a pain in my side which would not go away about 6 months ago. One week passed, two weeks passed. The doctor said I was OK. After 4 months the pain got worse, and spread from my right side over to my left and my left side from my waist up to my kidneys. It went from hurting some of the time to almost all of the time.

I had to go in for an abdominal ultrasound 3 weeks ago. If it was positive for what I hoped it was not, that meant I had about 3 months to put my affairs in order. How'd you like to walk around for a week knowing you have to go in for a test like this. It was not a good week. Anyway, I was Ok, no malignancy.

They are still running tests, and we are not sure what my problem is. I have some good days, and some days which are not so good. I should be ok God willing.

I have been lucky so far. I also learned that a lot of stuff is a lot less important than I might think. It's just a court case. You are not going to die, and you are not going to jail. Consider yourself lucky. It could be a lot worse.

I sat next to a couple of people in the hospital who knew they were up against it. They had a lot more to deal with than losing a court case and some bucks. You can make bucks. Peace.

They typically do not award opposing side attorney's fees

Could I ask how you know this? Paying $50K would pretty much ruin me so I would rather not pay it. And it's the defense's fault for delaying this for 3 years so he could get rich off the case.

You sued someone and lost, you should pay all attorney fees for both sides. Maybe next time you will not friviously sue someone. You got what you deserve.

Not really, the most he said I could get was $4k, although he'd get 5 figures in attorney's fees. He didn't tell me this until the offer was rejected. Anyways, the entire $2k would've gone to the lawyer.

You were going to get $4K and lawyer gets 5 figs? That math don't add up. That would a minimum 250% contingent fee. Can't be.

Well, I was involved in a lawsuit and the jury reached their decision today and not surprisingly it was in favor of the defendant. Which means that I will owe attorney costs and expert fees, which would total around $50K. I am doomed.

Damn, should have taken their settlement offer three years ago but my lawyer convinced me that we could win in court. Now he wants $10K in retainer fees so he can defend me from the defendant's lawyer from filing motions to get me to pay for their fees. Fuck America, fuck lawyers and fuck the "justice" system!!!!!!!!

What a sucker... Of course your lawyer's gonna tell you this shit.
