The old one does. Plenty of people can unlock it for about $100.
The 3G requires in-store activation which means in good theory you have to get it tied with an expensive ATT contract. The ICE will supposedly start distributing the 3G version next year when their 3G network goes live (Blackberryies too as well)...maybe sooner.
