I'm not sure it exists in the United States but in Europe there is a juridical concept (I apologize I forgot its latin definition) that more or less says that if a debtor has insufficient assets but states the intention to pay he may not be declared insolvent nor bankrupcy proceedings may be enforced. However a Court may rule that the debtor has to substantiate its intentions with tangible actions that support the intentions.
In this perspective BoS may bring the severance payments as tangible signs of the intention to pay.

Yes - if you were in your mid 50s or 60s and had $20 million, but owed $80 million what would you do? You'd let it go on and on and on and live a happy life.

Judge we were running our company legitimately and spent millions on ads for football and we made X millions each year on football and the DOJ basically costed us ____ millions. BOS could even try to get the UK, CR, or Antigua to force the US to pay for their losses as part of the settlement for wrongful indictment after the WTO ruled once... This all may be meaningless but sure as hell keeps them out of a UK jail and away from extradition.
The bottom line is none of us know their finances and none of us know what they will do.
What I am absolutely sure of is their lawyers have and likely are tossing around dozens of ideas and I know legal work takes a very long time.
