BHB has requested that our banners and links be taken down from MajorWagers site.

We pre paid for the year, with no contract that I remember signing, and want a refund for the remaining 9.5 months.

Although we only opened approx. 8 accounts from his site we are willing to pay a 50% higher rate for the fist 2.5 months since the Major feels these are his best months for thebooks to advertise there.

A refund of 10k is expected this week. (we paid 15k for the year) That means we are willing to pay 33% of our annual deal, when we only got 20% of the years exposure. Thats more than fair.

If they do have a contract please let them post it here. Either way, Russ knows what the right thing to do is.

Obviously if we cant get a refund we could keep our banners and links up all year long. However, we would rather lose the 10k AND the exposure than do business with Russ.

We will keep you posted.

Is there a stipulation in the contract that lets you cancel out before it expires which in turn would give you a refund?

I doubt anyone would put out a contract like that.

BillDozer and EGD both have posted a very valid question.

Did you sign a contract? If you did, for how long? If you decide to leave Majorwager before the time estipulated in the contract is due, then you're incurring into a breach of contract, which would legally allow Major to charge you for the period of time you initially agreed upon.

Just a friendly advise.

If you ask me, that was a bad business decision. Site wars come and go, but you're now in one unfavourable position. If you stay, you will have to apologize for having jumped the gun. If you leave, you are held responsible for the contract, if there's any

Is there a contract? And what does it say?

How do you signing a contract that you are saying wasn't there to begin with? No offense but that statement makes no sense.

I've dealt with advertising before, offshore & non offshore & I have never seen a contract put out where you could cancel before it expires & get refunded.

What fool would agree to such terms?

We never had a contract. We sent email back and forth. I agreed to pay the full year up front, and he said if I brought another book, that he would give me 2k off the next book. So 13k for the 2nd book.

I personally never signed a contract with them. We are not talking about a deal between AOL and Microsoft. BHB is a book and MW is a site. We pay them a fee to have banners there. If they take us down then they should refund our $$$. Its as simple as that. There's no in depth contract.

maybe it was just a verbal agreement, maybe we can get other sponsors and or posters to pull out of majorwager.

I understand you are a book & they are a site & I've dealt with this before & I always had contracts signed by both parties so everything was on the up & up.

I can see why you would want your money back if they took your banners down but how could you agree to pay for something & not have all the details ironed out on paper & signed?

So in the event that there was a contract here are my choices.

1 - continue advertising on their site since I cant get my money back anyway. or-

2 - pull my banners and links and lose the remaining funds.

My choice would be 2. If a site has enough balls to say "yes" I will take you down and not return remaining $$$. regardless of a contract or not. Its the right thing to do. If they dont return the funds then I dont want to have anything to do with them anyway.

The last time I talked to Russ he started the convo by yelling at me because I didnt get him another book. Talking about "you agreed to bring another book when you spoke to my guy, etc". The after calming him down and calling his guy on 3 way, he found out there was no promise of the sort. Then changed his tone.

The point is, these contracts are nothing more than a a useless piece of paper. Often what is negotiated between the two parties is not whats written. If they decided to take us down, do you really think we could take them to court and get our money back if the situation was reversed. the answer is no.

The situation is very simple. BHB wants nothing to do with MW.

Contract or not. Whether we get our money back or not.

Russ, you know what you should do.

What else is there to say.

If there is no point in the non-existing (according to BHB) contract saying that BHB should have a pro-rated refund if BHB decides to break the contract, BHB should get nothing at all.

And even if the point is there in the non-existing contract, BHB need a much better reason than "you say one of my friends might be in trouble, therefore I want my money back".

Why would anyone have anything to do with Major Wager, how many instances do we need to see?

I am sure they will have some bullshit reason, like always...
