Assault victim sentenced to jail for stabbing one of the three attackers

(1) "retreat when able to do so", so we're assuming the victim could have run

(2) citing the "use of deadly force", I'm going to suggest that a stab to the leg is not that. I guess that law is saying you should run and not kill somebody


It's obvious there's a lot of room for subjectivity in your citation. I'm guessing the defense attorney sucked. And, in the absence of other evidence or history, putting this guy in jail is a crime

I don’t disagree with you, but I believe he was charged because the incident was over and the attackers were leaving. I believe he chased after them and stabbed one of them and the way the CT law was interpreted was that this was not self-defense since it happened several minutes after the initial attack and the attackers were fleeing. Seems ridiculous this guy would serve any time, but the judge’s interpretation of the law accurate.

NORWALK — A Bridgeport man was charged with assault after police said he stabbed one of his assailants during a melee at a Main Street doughnut shop.
Multiple police units responded to Dunkin’ Donuts at 195 Main St. shortly after 4 p.m. Saturday on a report of an assault there.
Police said three juveniles entered the shop and assaulted an employee, Jeffrey Sumpter, with fists before the altercation spilled outside.
Approaching officers found the juveniles behind 205 Main St., Rainbow Plaza, an adjacent shopping center. One of them was bleeding profusely from a leg wound.
Norwalk police officer Jon Haggerty applied a tourniquet to control the bleeding until an ambulance arrived, and the juvenile was transported to Norwalk Hospital with serious injuries.
Police said Sumpter had a knife and stabbed one of the juveniles during the altercation.
Police did not indicate the reason for the initial assault.
Sumpter, 21, of Bridgeport, was charged with first-degree assault and risk of injury to a minor. His bond was set at $25,000 and he was given a court date of Oct. 11
According to court records, Sumpter pleaded guilty on Feb. 10 to third-degree assault and carrying a dangerous weapon following a December arrest in Bridgeport. He also has a pending violation of probation charge.

OK, so those are facts I couldn't find when looking for more substance (a brief search anyhow).

Given those facts, assuming they're real, it's odd the judge would say "I believe your story, but".

And I still think he probably walks with a decent attorney, at least the likelihood increases substantially

Sumpter, dressed in a white prison jumpsuit with short sleeves, did not reply. His public defender Howard Ehring said unlike a state like Florida, which has a law allowing its residents to stand their ground, Connecticut law requires Sumpter to retreat from the beating he was given at the Dunkin’ Donuts where he worked. After being assaulted inside the coffee shop, Sumpter ran outside and stabbed one of the men.

I'd have gone easy on him, but because of the laws on the books the judge had no choice... plus kid has a bad past so judge wasn't willing to go against the statute. If it was a guy with no prior history, he might have gotten bailed out.

Completely agree, I figured it was the judge voicing his opinion that the law is questionable at best.
