anyone know anything about child support?

ive been searching around the net but have not found the answers im looking for so i figured i would ask here. I live in Tx and have been paying child support for the past 8 yrs. now the mother wants more money and has filed a modification hearing set to go to court in september. when i was served the papers, the documents requested all sorts of things such as pay stybs, tax returns, social security forms, check statements, health insurance forms, and the big kicker, statements of any stocks i currently hold interest in. If i do not bring all this stuff in, will they just go with what i do bring? or is there a chance they have it already? Im thinking of telling them i dont have any money in stocks, as i basically dont, I have a trust that has 80,000 dollars in it but ive never been able to touch it as my dad wont let me and by law, the company wont let me touch that money, (ive already tried). so is there a chance the court could go after that money eventhough i dont even have access to it? could they force my dad to liquidate it , thus giving me the money and in change giving the mother 20% of that? or am i better off just saying that i do not have money in the market? I have no problem giving her 20 % of that if i get get the rest. what have you guys dome? or recommend? thanks.

Agree 100% get a lawyer and be prepared when you have to go,there is nothing wrong with supporting your child but dont let them take advantage of you at the same time.

no shes already getting 20% of my paystubs. this is just a modification to see if im making more money and if so, shes entitled to 20 % of those checks as well.

but thats my question, if they find the assets in the trust fund, can they make my dad liquidate the trust fund as I have no access to that money whatsoever, even if i really needed it, I could not tocuh it.

and do i really need to get a lawyer when we are talking maybe only 20-30 bucks more a month in child support? i dont make a lot of money and i would really rather not spend 1,000 dollars on a lawyer when i dont mind paying the 20-30 bucks more a month, i was just concerned about the money in the trust. also too, when i called the child support office, i was very specific to ask if i could just bring tax returns (which have no evidence of my trust on it), and pay stubs. they said that was fine. I also sent a certified letter stating that all i had was my returns and stubs.

but how can she get more then that as i understand it to be 20% by law, so she cant get anymore then that. she doesnt have a lawyerm its the state going with it but the mother doesnt even know about the stocks.

lol, shes already got a new guy, they got married, before he came along, i never had to pay anything. we already settled on back payment. thats taken care of. and ive been paying 20 percent of what i make for the past few yrs, so the case coming up is to do with future payments. i just want to know if the courts can force my dad to liquidate the trust or are they fucked and i dont have to worry about it.

Unless you know 100% that they are going to find something than you are broke - you don't have shit - and this comes from an attorney

Hey Seymour. good to talk to an attorney. I can totally afford the extra money a month. and i have no prob with that, i was just afraid because when i was served the papers, it asked for stock statements, tax returns, pay stubs, loan applications and a lot of other stuff that would take a long time to get. I dont even have statments for the stocks becuase, although, my name is on the accnt, I have no access to that money whatsoever. i just didnt know that if i go to the courts with only my tax returns and my paystubs, which the lady at the child support office already said was ok, would i get screwed in case they ask about my stocks. do they even know about the stocks? or are they usually cool with the returns and paystubs?

its not modification after 8 yrs, basically when the kid turned 8, she went after me for 42 k. I got a lawyer and we busted her lying so i only had to pay 4k in arrears and have been paying 20% of my pay every month since then. well now that its been 3 yrs shes going through with this in the hopes that im making more money then i was then. In texas you can modify every 3 yrs, and the three yrs just passed which is why shes doing this now.

How would they know what stocks you own? I assume they wouldn't - so you don't own any - and you can't even access the stock so DON"T MENTION IT
