Bush grants presidency extraordinary powers

Directive for emergencies apparently gives authority without congressional oversight

President Bush has signed a directive granting extraordinary powers to the office of the president in the event of a declared national emergency, apparently without congressional approval or oversight.

The "National Security and Homeland Security Presidential Directive" was signed May 9, notes Jerome R. Corsi in a WND column.

It was issued with the dual designation of NSPD-51, as a National Security Presidential Directive, and HSPD-20, as a Homeland Security Presidential Directive.

The directive establishes under the office of the president a new national continuity coordinator whose job is to make plans for "National Essential Functions" of all federal, state, local, territorial and tribal governments, as well as private sector organizations to continue functioning under the president's directives in the event of a national emergency.

"Catastrophic emergency" is loosely defined as "any incident, regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the U.S. population, infrastructure, environment, economy, or government functions."

Corsi says the president can assume the power to direct any and all government and business activities until the emergency is declared over.

The directive says the assistant to the president for Homeland Security and Counterterrorism, currently Frances Fragos Townsend, would be designated as the national continuity coordinator.

Corsi says the directive makes no attempt to reconcile the powers created for the national continuity coordinator with the National Emergency Act, which requires that such proclamation "shall immediately be transmitted to the Congress and published in the Federal Register."

A Congressional Research Service study notes the National Emergency Act sets up Congress as a balance empowered to "modify, rescind, or render dormant" such emergency authority if Congress believes the president has acted inappropriately.

But the new directive appears to supersede the National Emergency Act by creating the new position of national continuity coordinator without any specific act of Congress authorizing the position, Corsi says.

The directive also makes no reference to Congress and its language appears to negate any requirement that the president submit to Congress a determination that a national emergency exists.

It suggests instead that the powers of the directive can be implemented without any congressional approval or oversight.

Homeland Security spokesman Russ Knocke affirmed to Corsi the Homeland Security Department would implement the requirements of the order under Townsend's direction.

The White House declined to comment on the directive.

You do realize Bush will be President for about 19 more months. After that time, his successor will have those same powers.

I was obviously being facetious. Although with stuff like this we move a step closer. My point is it's just getting out of control at this point. This on top of the gazillion of signing statements bush has written since 9/11 as well. 9/11 just gave the fascists the excuse to push through alot of shit they've had on the backburner for a long time. To strip the people of as many freedoms as possible and give the central government more power to do as they please. This basically says that the president can say okay I declare an emergency, that is very loosely defined, screw congress. Not once in the text even from the white house does it mention congress. It babbles some garbage about "Enduring Constitutional Government" but that's a bunch of hogwash. Just very scary stuff that should have every american concerned IMO. As usual most american's won't know about/won't care (the complacency is so thick at this point) about this issue as usual and as with most of these types of things you will not even hear 1 second discussing this particular directive in the mainstream press.

When the next terrorist attack will strike america, Bush will use this pretext to cancel the elections, suspend the constitution and declare martial law.

Wouldn't surprise me one bit.

Some of the least noticed and least discussed changes in the law were the changes made to the Insurrection Act of 1807 and to Posse Comitatus by the Defense Authorization Act of 2007.


These changes pose a threat to the survival of our republic by giving the president the power to declare martial law for as little reason as to restore “public order.”



The 1807 Act severely restricted the president in his use of the military within the <st1:country-region w:st="on"> <st1:place w:st="on"> United States</st1:place> </st1:country-region> borders, and the Posse Comitatus Act of 1878 strengthened these restrictions with strict oversight by Congress. The new law allows the president to circumvent the restrictions of both laws. The Insurrection Act has now become the “Enforcement of the Laws to Restore Public Order Act”. This is hardly a title that suggests that the authors cared about or understood the nature of a constitutional republic.


Now, martial law can be declared not just for “insurrection” but also for “natural disasters, public health reasons, terrorist attacks or incidents” or for the vague reason called “other conditions.” The President can call up the National Guard without Congressional approval or the governors’ approval and even send these state guard troops into other states. The American republic is in remnant status. The stage is set for our country eventually devolving into a military dictatorship and few seem to care.


These precedent setting changes in the law are extremely dangerous and will change American jurisprudence forever if not reversed. The beneficial results of our revolt against the king’s abuses are about to be eliminated and few Members of Congress and few Americans are aware of the seriousness of the situation. Complacency and fear drive our legislation without any serious objection by our elected leaders.


Sadly, those few who do object to this self evident trend away from personal liberty and empire building overseas are portrayed as unpatriotic and uncaring.


Though welfare and socialism always fails, opponents of them are said to lack compassion. Though opposition to totally unnecessary war should be the only moral position, the rhetoric is twisted to claim that patriots who oppose the war are not “supporting the troops”. The cliché “support the troops” is incessantly used as a substitute for the unacceptable notion of “supporting the policy” no matter how flawed it may be. Unsound policy can never help the troops. Keeping the troops out of harm’s way and out of wars unrelated to our national security is the only real way of protecting the troops. With this understanding, just who can claim the title of “patriot”?

Let not those who love the power of the welfare/warfare state label the dissenters of authoritarianism as unpatriotic or uncaring. Patriotism is more closely linked to dissent than it is to conformity and a blind desire for safety and security. Understanding the magnificent rewards of a free society makes us unbashful in its promotion, fully realizing that maximum wealth is created and the greatest chance for peace comes from a society respectful of individual liberty.
