Active duty forces by law cannot engage in law enforcement actions.

Coast Guard does, which obviously doesn't apply to Minnesota. MPs do enforce federal law, which could maybe apply there, but probably not. Insurrection Act gives the president the authority to use the military to enforce laws

Whenever the President considers that unlawful obstructions, combinations, or assemblages, or rebellion against the authority of the United States, make it impracticable to enforce the laws of the United States in any State or Territory by the ordinary course of judicial proceedings, he may call into Federal service such of the militia of any State, and use such of the armed forces, as he considers necessary to enforce those laws or to suppress the rebellion..


Trump already used this to deport illegal immigrants after he decided against building The Wall.

I don't know what else to tell you or how else to say it nicely. Title 10 Federal Active duty forces cannot enforce state laws in U.S. States. They can't and won't. It's illegal. Can they man a desk while a state cop goes out to enforce laws? Yes they can but AD forces cannot enforce state law.

All the laws that roadreeler wanted enforced when he said Trump might have to send in the Marines. If there are no federal laws that need enforcement, he wouldn't have said that.

This just isn't true at all.

If you arrest someone, you can only hold them for 24-48 hours without charging them. If you're going to arrest someone, you need to have the intention to charge them and if you overcharge them, they will walk.

This is the stuff of television drama shows

Prosecutors can choose to escalate or to diminish charges all the way through a jury verdict/guilty plea bargain

Via Harry Litman, former USAttorney and current law professor at UCLA:

Derek Chauvin charged with 3rd degree murder. Minnesota one of only 3 states to have that charge on the books. Roughly equates to "depraved-heart" murder or causing death unintentionally but by an act eminently dangerous to others and evincing a depraved mind."

He then opines:

It's the right charge under Minnesota law. 2nd degree still requires proof that he intended to cause death. an overcharge there could well lead to an acquittal. And sentence for 3rd degree is up to 25 years.
