A federal judge on Monday ruled that some of Pennsylvania Gov. Tom Wolf's restrictions implemented amid the ongoing coronavirus pandemic were unconstitutional -- marking a win for businesses struggling to stay afloat amid the forced shutdown.

U.S. District Judge William Stickman IV, who was appointed by President Trump, sided with plaintiffs that included hair salons, drive-in movie theaters, a farmer's market vendor, a horse trainer and several Republican officeholders in their lawsuit against Wolf, a Democrat, and his health secretary.

The ruling found that Wolf's restrictions that required people to stay at home, placed size limits on gatherings and ordered "non-life-sustaining" businesses to shut down were unconstitutional.

The Wolf administration's pandemic policies have been overreaching, arbitrary and violated citizens' constitutional rights, Stickman wrote in his ruling.

The governor's efforts to slow the spread of the coronavirus "were undertaken with the good intention of addressing a public health emergency," Stickman wrote. "But even in an emergency, the authority of government is not unfettered."

Courts had consistently rejected challenges to Wolf's power to order businesses to close during the pandemic, and many other governors, Republican and Democrat, undertook similar measures as the virus spread across the country.

Wolf has since lifted many of the restrictions, allowing businesses to reopen and canceling a statewide stay-at-home order.

won't change anything here. when asked if he would reconsider the crazy restaurant lockdown PA is still under Wolf said that he has more important things to worry about. what a cock

fact is PA Oct-Dec restaurants do between 35-40% of their business due to Fri high school football and of course sat/sun so they are fucked

Wolf will allow 50% capacity but only if restaurants agree to weekly, possibly even daily, visits from the new COVID task force. They are trying to sucker restaurants into this so they can get massive fines paid back to them. plus most bars don't have enough space to go from 25>50% and still maintain the 6-ft rules because Wolf will not allow bar service, only table service.

crazy governor

Not many are following the 25% capacity in Pa.......I drive by & see restaurant parking lots packed.

But I also do hear some restaurant owners complaining how their business has been destroyed by these lockdowns.

The fancy/more expensive restaurants are getting killed.......if you have a restaurant now, you want a family style diner or the best is a place where you sell sandwiches & fried chicken, etc & alcohol & mostly take out & delivery is where the money is from here on out.

ours are pretty empty here unless you have a large outside patio. but psycho mayor peduto created an Allegheny County covid task force to drive around and harass bars to create as unfriendly an environment as possible. the insanity behind no bar service and demanding that each and every customer buy an entree prepared onsite isn't lost on many of us

The bars around my area are closed as well I believe......I'm not a drinker, but I do hear people complaining. Have some friends that like going out drinking while watching football & they said they can't wait until the bars open up again......I'm assuming it's the bats without food, cuz if you have food, you can be open I think.

correct. breweries or distilleries that do not make food onsite are banned from opening. bars that do prepare food onsite are 25% indoor capacity and each patron must have prepared food in front of them at all times (not chips or a pretzel or even a basket of fries).

remember, this is about a virus ;)
