i audiotaped a call to scamdicapper - and want to make it available for all to hear on the internet.

can ANYONE help me out here?

do you have the capability to turn an audiotape into a file i can play on the internet? if so - let me know.

if possible - i can call you and send it to you that way. if that is cool - send me an e-mail to the address listed below. if you include your phone number i will call you before 5P (PST) saturday and we can do it that way. sunday - who knows - but we can work that out.

i won't say who i called - other then to say - i think y'all will enjoy it A LOT!

I am sure the call is funny, but am worried the scamdicapper could come after you legally. I would find out what the law is on tapping calls to avoid aggravation in the future.

Even though you are not teaching me anything new, your scamdicapping articles are very entertaining. Good luck with you in 2004 winky.

1. Did you tell them the call was being taped?
2. What state are you calling from?
3. What state did you call?

The law varies from state to state.

Federal law requires the consent of at least one party (YOU). 38 states have modeled similar state statutes.

Unfortunately for you, both California and Florida require consent from BOTH parties for a recorded conversation.

In cases where the call is made from a "single party" state to an "all parties" state, the law is less clear. Often, federal law would apply, but it CAN be argued that the state law where the "injury" occurred will apply. In either case, it doesn't matter in this situation.

You CAN be liable for criminal and/or civil charges.

BTW, there are additional penalties under CA law for publishing or disclosing the information - separate from merely recording it. Florida law does not have additional penalties.
