UK troops 'beat Iraqi to death'

British soldiers killed a 26-year-old Iraqi civilian by repeatedly beating him on the neck, chest and genital areas, High Court judges have heard.
Baha Mousa was one of six Iraqis whose families are challenging the UK Government's decision not to hold an independent inquiry into their deaths.

Fellow hotel worker Kifah Taha al-Mutari said soldiers competed to see who could kick detainees the furthest.

The six test cases include the shootings of four Iraqi civilians.

The victims were either at home, walking in the street or driving when they were shot, allegedly by soldiers from the Kings Own Regiment.

The deaths of Mr Mousa and an Iraqi police commissioner shot while on his way to a judge's house were allegedly caused by soldiers from the Queen's Lancashire Regiment.

I wish to know why I was detained and treated so badly by British troops and I believe there should be an independent investigation

Iraq case crucial for UK military

Two High Court judges must decide whether the Human Rights Act 1998 applies to the British troops in south east Iraq during the period of occupation and, if so, whether there should be an independent inquiry to investigate the alleged post-war deaths of a total of 37 Iraqi civilians.

Rabinder Singh QC, appearing for the Iraqis in the six test cases, told the judges European human rights laws, which protect the right to life and freedom from torture or inhuman and degrading treatment, applied to troops in Iraq and the government was obliged to investigate.

But lawyers for Defence Secretary Geoff Hoon say the Human Rights Act, which incorporates the European Convention on Human Rights into UK domestic law, can only be applied inside UK territory.

During his opening, Mr Singh read from a witness statement from Mr al-Mutari, who was arrested at the same time as Mr Mousa and five other hotel workers.

He alleged detainees at a British military base called Darul Dhyafa were beaten on the neck, chest and genital areas, hooded, deprived of sleep, and had freezing water poured over them.

'Freezing water'

"We all had another hood put on top of the first hood.

"We were given water by it being poured over the hood so that we had to lick the droplets that seeped through the hood.

"Freezing water was poured on to us and this was very painful as the temperatures in detention were 40 degrees plus."

Mr al-Mutari added: "Soldiers took turns in abusing us.

'Beaten severely'

"At night the number of soldiers increased, sometimes to eight at a time.

"We were prevented from sleeping throughout the three days as soldiers introduced the 'names game'.

"Soldiers would mention some English names of stars or [football] players and request us to remember them, or we would be beaten severely."

Mr al-Mutari said: "One terrible game the soldiers played involved kickboxing.

'Jabbing movements'

"The soldiers would surround us and compete as to who could kickbox one of us the furthest.

"The idea was to try and make us crash into the wall."

Mr Mousa, who "appeared to have much worse ill-treatment than the others", was then taken to another room, where he allegedly received more beatings.

Mr al-Mutari added: "On the third night Baha was in a separate room and I could hear him moaning through the walls.

"He was saying that he was bleeding from his nose and that he was dying.

"I heard him say, 'I am dying... blood... blood...'.

"I heard nothing further from him after that."

Blood and bruises

A witness statement by Mr Mousa's father, Daoud Mousa, was also before the court.

In it he recalled seeing his son's body covered in blood and bruises: "He had a badly broken nose. There was blood coming from his nose and mouth. The skin on one side of his face had been torn away to reveal the flesh beneath.

"There were severe patches of bruising over all of his body. The skin on his wrists had been torn off and the skin on his forehead torn away and there was no skin under his eyes either.

"I literally could not bear to look at him."

The case continues.

this is a very uneducated answer... eek is by no means supporting those behaviours... nobody would. Remember, the co-alition mission in IRAQ is to change mindset, bring democracy, & remove a dictator... How can we bring this security & trust to the region if our soldiers behave this way... Why are our soldiers behaving this way?

It is imperative that the co-alition be held to the highest of standards... It is not OK to abuse prisoners just becauz other IRAQ's have abused Americans... We do not live in a society where "an eye for an eye" is the law.

We have JUSTICE, there are decent standards that we are trying to bring forward...

WHen folks like you use the ANALOGY you used above it makes me shutter... IT is such a WEAK argument that it is uncanny... Please re-consider your statement

BTW. Us Brits had the same sense of outrage in previous generations, when those darn colonial johnnies started fighting back.

These liberals post all negative about the good guys and never post anything good they do. I've never seen one of them outraged when Americans are executed. Posting garbage like this is done for one reason and that's to under mind Americas and UKs efforts. I stand by my comments. Thanks

what you just said in your last post is a very valid comment... Liberals not voicing anything good that the administartion done... very good comment.

HOWEVER...

Not related to a Comparison implying it is OK to beat a IRAQI prisoner to death or to Humiliate a Prisoner by forcing them to eat PORK or denounce their religion, simply becauz there are Islamic Extremists Blowing up buildings & chopping off heads. WE all know the extremeists are wrong... we do not have to be convinced of that.... What we do not deed is the population thinking "An eye for an eye" is OK. Or "they got what they deserved as they did it to our boys". This is REDNECK ideology & philoshophy.

Please reconsider your thoughts... or clarify... but if we are talking about apples lets keep the conversation on apples please.

I was once told by a disenchanted Muslim of Arabic lineage that pork could be eaten to save your life. If that's true, this scenario is a little overblown. The soldiers forcing the prisoners to eat anything is one thing but I don't think pork should be singled out.

Our entire legal system is supposed to be set up to administer an "eye for an eye" instead of 1 year in jail, 2,000 hours of community service and 2 years suspended sentence for an eye. However, there's no due process and that's where they erred.

I'm all for the torture and execution of criminals just as long as they've had a trial.

that is the most idiotic thing I have ever heard, this was not life or death... this was simply to humiliate... They were also told to denounce their religion...

anyway... not gonna try & squeeze blood from a stone or turn a neck that is red into a normal human shade.

our system takes into account:

DANGER TO SOCIETY
PUNISHMENT
CHANCE FOR REHABILITATION
CRUEL & UNUSUAL PUNISHMENT is forbidden...

also punishment is only one factor...it does not make up the entire system & is not literal.

By that, I'll assume you mean Canadian. In the American system, the death penalty was an alternative for certain crimes from the beginning and it wasn't considered cruel and unusual.

With regards to the other post, I was hoping you could provide evidence to refute what I heard instead of giving me "The world according to SportSavant". We don't know what those soldiers said to the prisoners. Given that some were beaten to death, they may have been in fear for their life and should not bear any guilt from you or anyone else for eating pork. Since you can't or won't provide me with even a hint of where I might learn about this in the Qu'ran (something as small as the book would be of help) I'll assume that you don't know.

If you're so concerned with their welfare, why not buy a ticket to Iraq and help kill the evil rednecks. Hell, you could come to the U.S. and do the same thing. Consider it your gift to the world.

Now while the shootings may have had some justification(ie. The arrogant police chief driving through a road block gets shot scenario) the systematic totally pointless beating to death of any civilian over an extended period of time shows a serious breakdown in discipline.

The officer/NCO in charge of the lunatics who commited this atrocity should receive the harshest sentence of all of them IMO.

Even the insane beheadings by the islamic whackos had an objective.
To scare the pants off the other infidels, so that they would leave occupied Iraq.
