No sooner had the Labor Day speeches extolling American workers ceased than the leaders of the U.S. House of Representatives decided to bring up a bill this week to inflict 550,000 stab wounds onto those American workers.

That's right: A week after we hear that official unemployment is at a 5-year high, House leaders are going to try to move a bill to offer 550,000 MORE permanent greencards, above the 1 million immigrants already planned!

This is a red-alert crisis.

That means you and everybody you know needs to read about the emergency and look over the opportunities for action at:

EXCERPTS FROM BLOG ABOUT THE PRESENT CRISIS

Here's another entry in the contest to find out whether many politicians are just stupid or are cynically evil:

THE CRISIS: The feds announced last week that our official unemployment rate has soared to 6.1%, the highest since September 2003.

THE CONGRESSIONAL RESPONSE: But this week, we get to see what ACTIONS the politicians plan for us. First out of the blocks, the Democratic Leadership of the U.S. House of Representatives is responding this week by trying to shove through a bill -- H.R. 5882 -- which would provide about 550,000 permanent green cards to foreign workers next year. And those would be ABOVE the 1 million permanent green cards already planned!

AMERICANS NEED JOBS -- NOT FOREIGN WORKERS

Let's take a quick look at the employment statistics that don't seem to matter to Members of Congress who are pushing H.R. 5882:

The official unemployment rate soared 0.4 percentage point to 6.1%, the highest since September 2003. The unemployment rate was under 5% as recently as February.
342,000 jobs were simply eliminated throughout the economy last month.
And the number of people officially looking for work and unable to find it rose by 592,000.

REP. ZOE LOFGREN IS THE ENEMY OF UNEMPLOYED WORKERS

There are so many Members of Congress who work primarily for the interests of the cheap-labor lobbyists, it is difficult to single out just one to be the face of all that is idiotic, cynical and callous about our immigration policies.

But Rep. Zoe Lofgren (D-Calif.) gets to be that face this week. She is chair of the House immigration subcommittee. She long has served on that committee, doing the bidding of the corporations in her Silicon Valley District.

But her decision to move H.R. 5882 through the Judiciary Committee is not just about getting more higher skilled foreign workers instead of hiring American tech workers.

No, this time she's bringing in foreign workers to take nearly every kind of job in America. The only criteria really is that you have a couple of years experience in the type of job you would be taking from an American worker. These 550,000 extra greencards would be for engineers, health workers, construction workers, service workers, manufacturing workers -- well, they would go to foreign workers who do all the kinds of jobs that have been disappearing!

FALSE PRETENSES FOR PUSHING H.R. 5882

Rep. Lofgren and other pushers of H.R. 5882 think they have come up with a really clever way to get around the general public opposition to immigration increases.

Their gimmick is "Recapturing Unused Employer-Sponsored Visas."

Every Member of the House Judiciary Committee should be phoned and told that 592,000 additional Americans were thrown onto the official unemployment rolls last month (and that doesn't count the millions already unemployed), and that the 550,000 jobs that H.R. 5882 would give to foreign workers ought to go to the unemployed Americans.

And please don't let the congressional staff tell you that these foreign workers are needed because unemployed Americans are looking for different kinds of jobs.

These 550,000 greencards would go to virtually every kind of foreign worker. And virtually every kind of American worker is losing jobs right now.

A vote on HR6630 is expected on the House floor sometime Tuesday, and truckers are being urged to call their lawmakers in support of the measure.

The bill got off to a running start when it was introduced in late July.
The bipartisan bill not only seeks to mandate the end of the current program, but also goes further. It seeks to restrict any more authority to operate beyond the border zones from being doled out to Mexican motor carriers without prior approval from Congress.
The bill drew immediate support from the OOIDA.
“Our members have been active in fighting this program for a long time by voicing their concerns to lawmakers, and we thank them for staying involved,” said Todd Spencer, OOIDA executive vice president.
Rep. Peter DeFazio, D-OR, along with co-sponsors Rep. James Oberstar, D-MN, Rep. John J. Duncan Jr., R-TN, and Rep. John Mica, R-FL, introduced HR6630 late in the day on July 29.
The bill passed the House Committee on Transportation and Infrastructure unanimously two days later – teeing the bill up for consideration by the full house when members returned from the recess on Sept. 8.
The bill calls for the ongoing cross-border trucking program with Mexico to end no later than Sept. 6, 2008 – one year to the day after the program was launched by the U.S. Department of Transportation.
As a first matter of business, the bill mandates an end to the current demonstration project. But, in a move to prevent any other programs from cropping up, the bill also seeks to restrict the U.S. Department of Transportation from granting authority to any more Mexico-based motor carriers to operate beyond the commercial zone after Sept. 6.
The bill goes far beyond just seeking an end to the current program and preventing a new one from starting up. DeFazio and the other co-sponsors obviously want to know the real impact of the program. The bill mandates a couple of reports dissecting the goings-on in the program.
First, the bill reiterates the fact that the DOT’s Office of Inspector General is to complete a report reviewing complete compliance of the program as required by Section 6901 of The U.S. Troop Readiness, Veterans’ Care, Katrina Recovery and Iraq Accountability Appropriations Act of 2007.
Such OIG audits have been required since the passage of the 2002 transportation appropriations legislation Section 350. However, that legislation only required the OIG to sign off on FMCSA’s compliance on just eight provisions within Section 350 and update its audits annually. DOT officials could just certify that the department complied with the rest of Section 350.
Not so anymore with the passage of Section 6901. The Inspector General is now required by law to certify DOT’s compliance with 22 additional provisions for conducting a cross-border program with Mexico.
DeFazio’s current bill calls for the audit of the 22 additional provisions to be completed 60 days after the bill is signed into law.
HR6630 also addresses oversight of the program. The bill seeks to establish an independent review panel that is to report to Congress on a variety of aspects of the program.
The independent panel is called on to:
  • Evaluate the effects on motor carrier safety, including an analysis of any wrecks involving motor carriers participating in the demonstration project;
  • Recommend modifications to the process of granting authority to Mexico-based motor carriers to operate beyond the commercial zones; and
  • Recommend modifications needed for monitoring future operations of participating carriers.
The bill also calls for the Secretary of Transportation to report on a variety of details on the program in a report to Congress. The secretary would be required by the bill to report to Congress:
  • The number and names of U.S. and Mexico-domiciled motor carriers that participated in the program and how many vehicles each one utilized;
  • The number of border crossings by each of the participating carriers, including the number of crossings that resulted in the motor carrier operating beyond the commercial zone;
  • An itemization of safety and operations violations found in pre-authorization safety audits, compliance reviews and roadside inspections along with a breakdown of the most frequent violations;
  • A cost analysis to both the federal government and the states for implementing and overseeing the cross-border program; and
  • Steps taken to terminate the authority to operate beyond commercial zones of motor carriers participating in the program after the end of the program.

"Please vote NO on every bill that would add foreign workers of any kind at a time when we are suffering our worst unemployment in five years."

Just as we had seemed to push back attempts for massive increases in foreign workers by the U.S. House, we now learn the danger has risen to Orange Alert level in the Senate.

We had counted on Republican Senators to agree to stand up to the blackmail of Sen. Menendez that we've been telling you about for the last month. (Read background in my previous blogs.) Sadly, we have learned that an undetermined number of Republican staffers are now plotting with Menendez (D-N.J.) to increase foreign workers during a time of rising American unemployment.

Menendez -- you may recall -- has put a hold on re-authorization of the E-Verify on-line program that keeps illegal aliens out of jobs.

He has been saying he will let the Senate vote to keep the program going IF the Senate will also add hundreds of thousands more permanent immigrants. Our understanding has been that Senate Majority Leader Reid (D-Nevada) was ready last week to over-rule Menendez and bring E-Verify to the floor. And it looked like Reid was willing to do it without adding extra foreign workers.

Then at the end of the week, several Republican staffers seem to have re-opened the whole thing to add foreign workers, apparently to satisfy the demands of special interest lobbyists.

Nothing but overwhelming faxing and phoning from their constituents will spare us from this catstrophe.

HERE ARE THE AMERICANS BEING SACRIFICED
IN BACKROOM SENATE NEGOTIATIONS


While voices are raised behind closed doors in the Senate to give away hundreds of thousands more jobs to another round of imported foreign workers, consider these stunning statistics:

In August, 592,000 additional Americans were added to the official unemployment rolls.

Total number of Americans who are officially unemployed, looking for a job and can't find one? 8.28 million!

Current official unemployment rate (highest in 5 years)? 6%

Official unemployment rate considerably higher for Hispanic women: 8.7%

Rate twice as high for Black American men: 12.3%!

It has been hard enough to understand Sen. Menendez' callous attitude toward these unemployed Americans.

But can you believe there are others on Capitol Hill who are this out-of-touch?

Or this ruthless in efforts to appease special interest lobbyists?

Our message to every Senate office has to be:

1. No increase in immigration and foreign workers of any kind.

2. Re-authorize E-Verify without any strings -- just like the House did a month ago.


Friends, Congress will try to get out of town in just two weeks. There will be incredible pressures to pass all kinds of terrible immigration measures for this country. I beg you to watch for our Alerts, to read them and respond to them even if they come daily -- even several times a day.

This next two weeks is a time of dire danger for the nation, and especially for the nation's unemployed, the nation's blue-collar and service workers and for the nation's information technology workers and nurses (as well as students seeking to enter those fields).

I appreciate you're concern though..I stick upfor McCain because I know Baldwin wont win but I really hate Obama..Baldwin is 100% anti Immigration legal & Illegal

Thanks to your calls and e-mails last week, efforts to pass four detrimental immigration-related bills stalled in the House Judiciary Committee. Unfortunately, victory was short-lived. Committee leaders remain committed to passing these bills, which would flood the workplace with hundreds of thousands of worker visas. The Judiciary Committee is meeting again Wednesday, September 17th for another try!
Three of the four bills to be considered in Wednesday's markup amount to nothing more than gifts to big business special interests seeking to dramatically increase the stream of cheap foreign labor coming into the American workforce during these tough economic times:
  • H.R. 5882 would reach back to 1992 and "recapture" employment-based and family-based visas, potentially adding over 550,000 new green cards.
  • H.R. 5924 would lift the cap on employment-based visas for nurses and physical therapists until 2011.
  • H.R. 6020 would grant amnesty to illegal aliens who are family members of armed forces personnel.
In addition, the House Judiciary Committee will be considering H.R.5950, which sets forth vast new alien detainee healthcare requirements that Immigration and Customs Enforcement (ICE) would have to implement in all of its detention centers. ICE facilities - which have a mortality rate far below the averages for both the U.S. jail system and the general public - already provide every detainee with comprehensive medical screenings, which often result in original diagnosis and treatment of chronic conditions. This unnecessary bill - a clear tactic by open borders advocates to slow law enforcement - will only serve to add extra bureaucratic burden to ICE.
Please, call your Representative right now and remind them that the economy is ailing and the last thing America needs is more work visas. Tell them you want them to pass true immigration reform legislation that restores common sense and integrity to our immigration system, secures the border, and imposes tough sanctions on employers addicted to cheap labor.
Then, please call Members of the House Judiciary Committee today and tell them not to bow to cheap labor interests and that you oppose each one of these bills!

URGENT: The Senate Must Act to Pass E-Verify
The economy is ailing and many Americans are out of work, yet the Senate leadership remains unwilling to protect American workers from having their jobs taken by illegal aliens. With time running out, Senate Majority Leader Harry Reid remains unwilling to even bring an E-Verify re-authorization bill to the floor. This critical program will end in November if the Senate does not act before their upcoming target adjournment date. The House overwhelmingly voted 407-2 to re-authorize E-Verify last month, and it's time for the Senate to do the same thing. However Reid - bowing to special interests and Senator Robert Menendez's insistence on hundreds of thousands of cheap foreign workers - is refusing to even bring H.R.6633 to the floor.
We understand that Senate staffers are negotiating with leadership today regarding whether to bring the re-authorization to the floor. Please call your Senators and Senator Reid's office today and tell them to bring E-Verify to the floor with no strings attached.

URGENT: Stop House Leadership from Granting Amnesty under the Guise of Helping Our Military
The House Judiciary Committee, under the pretense of supporting our troops, voted late Wednesday afternoon to grant amnesty to the illegal alien family members of servicemen, even if these individuals have committed serious crimes. H.R.6020 does not reward servicemen, but instead grants broad amnesty to any extended family members who may be illegal aliens. Additionally, it gives immigration judges the discretion to waive deportation orders for those family members who have committed a crime. Although members of the committee were able to exclude a few serious crimes, the bill gives broad discretion to immigration judges to waive deportation of a criminal alien.
The American Legion, which has expressed opposition to the bill, testified in May: "This would seem to reward law breakers and - possibly - illegal immigrants with a short cut to citizenship that is nothing less than an official pardon for illegal acts: an amnesty."
Please call your Representative today and tell them to oppose all efforts to bring H.R.6020 to the floor.

Last week Senator Jeff Sessions (R-AL) attempted to bring E-Verify to the Senate floor for a vote, but, once again, Senator Robert Menendez (D-NJ) has blocked E-Verify and won't let it pass unless he is allowed to add hundreds of thousands of foreign workers to our struggling economy. E-Verify, an inexpensive, effective, and indispensable work-site enforcement tool that instantly and electronically verifies the legal work documentation of new employees, has proven its worth as an essential tool in turning off the job magnet that encourages so many to enter the country illegally. If the program is not reauthorized, advances that we have made in the state legislatures such as Arizona and Mississippi with E-Verify as a cornerstone will be destroyed. Additionally, a new rule requiring federal government contractors to use E-Verify will be rendered worthless. If Senator Menendez is successful in destroying E-Verify, the United States will have lost one of its most effective tools in thwarting illegal immigration.
In an outrageous act toward American workers, Senate Majority Leader Harry Reid (D-NV) has turned a blind eye to Senator Menendez's actions and seems content to let E-Verify die. We have to let Senator Reid know immediately that the American people will not tolerate the Senate permitting E-Verify to die, especially after the House overwhelmingly passed a five year reauthorization of E-Verify with only two members voting against it. We are calling upon you to help us make sure that this doesn't happen.
Urgent Action Items:
Please, call your Senators and Senate Majority Leader Harry Reid's office (202-224-3542) today and every day until they bring E-Verify to the Senate Floor.
Tell your Senators to insist that their leadership not allow Senator Menendez to kill E-Verify and to bring H.R. 6633 to the Senate floor.
Call Senator Reid's office and tell him you want H.R. 6633 brought to the Senate Floor immediately with no strings attached.

E-verify In Danger of Expiring

The fate of the federal immigration verification system E-verify, a keystone of the immigration package passed by South Carolina lawmakers this year, now is being negotiated by senators who must renew the program in coming weeks or see it expire.

Because Congress plans an election recess by the end of the month and E-verify will expire in November unless it is renewed, Capitol Hill staffers say senators must make a decision soon on what to do with the program, which passed the House by overwhelming numbers in August.

U.S. Sen. Robert Menendez, a New Jersey Democrat who in August held up a bill to renew the program, has asked that in addition to renewing E-verify, the Senate also 'recapture' unused or unclaimed family and work-sponsored visas for the last 15 years, provisions critics say could allow up to 600,000 more immigrants and workers into the country.

'There is really only one person standing between E-verify and reauthorization and that is
Sen. Bob Menendez,' said Ira Mehlman, a spokesman for the Federation for American Immigration Reform. 'Given that our economy is losing jobs by tens of thousands every month, this is not the time to go looking for more workers to bring to the country.'

Co-sponsoring Menendez' bill are Senators Patty Murray and Maria Cantwell of Washington and Ted Kennedy of Massachussetts.


Holding up renewal of E-verify at a time when American workers need job security is unconscionable.

E-verify deserves to be reauthorized on its own merits and shouldn't be laden with all sorts of benefits for business interests. It is time to tell Sen. Menendez to step aside.

Call our two US Senators from North Carolina, thank them for past support on real immigration reform, and press them to fight hard for the Senate passage of HR 6633 before the end of this week. Tell them we need to reauthorize E-Verify to protect American workers who need jobs, with NO foreign worker and NO green card additions to the bill.

Senate Majority Leader Harry Reid (D-Nev.) has two honorable choices:
  • No. 1: Go around Sen.Menendez who has a "hold" on H.R. 6633, the "clean" E-Verify re-authorization bill passed by the House. Sen. Reid can bring this back-room filibuster to the Senate floor for a vote. If he does this, there easily will be the 60 votes necessary to stop Menendez and allow an overwhelming majority vote to pass H.R. 6633. (Reid reportedly doesn't want to do this because he doesn't want to force some of his Democrats to have to go on record just before the election.)
  • No. 2: Avoid a vote altogether by talking to Menendez privately, persuading him that what he is doing is threatening the reputation of the Democratic Party just before elections and get him to withdraw his "hold" on H.R. 6633. (This way, Reid could then bring H.R. 6633 to the floor in the "hot-wire" fashion which will pass by voice vote.)
Either way, the American worker and public wins. It is all about Reid doing one of those two things.
This is why we want you to put particular pressure on Democratic Senators to put an end to Menendez' shameful grandstanding. Fortunately, Senate Republicans are standing firm against Menendez.
The weakest and most vulnerable American workers -- and non-workers -- will benefit the most from your willingness to step forward and take action this week.


SEN. MENENDEZ' E-VERIFY BLACKMAIL DEAL

After we told you that some Republican Senate staffers were working with Sen. Menendez (D-N.J.) for massive increases in foreign workers, you hammered Republican offices for not holding the line for a "clean" E-Verify bill.
Your efforts really worked. By the end of this last week, Republican Senate staffs were going into negotiations with Democrats and making it clear they were united in oppositiion to a foreign-worker surge at this time of 5-year-high unemployment and financial industry collapse.
Sen. Menendez apparently is not bothered by the 5-year-high official unemployment rate -- or even by the 292,000 additional American workers who went on unemployment in August alone. He is insisting that if we keep E-Verify, then we have to add another 550,000 foreign workers next year to the 1.1 million immigrants already scheduled to come.
(AS A REMINDER: E-Verify is the central tool for taking away the job magnet from illegal immigration. The U.S. Chamber of Commerce wants to kill it so outlaw businesses will have more freedom to hire illegal workers. E-Verify is the on-line system that businesses can type into for each new hire and find out if they are an illegal alien.
(If you live in Arizona, Oklahoma, Georgia -- or any other of the places that have started mandating that businesses use E-Verify -- your efforts to combat illegal immigration will be halted. )
THE MENENDEZ/SESSIONS WRESTLING MATCH

Thursday night on the floor of the Senate, Sen. Sessions (R-Ala.) tried to "hot-wire" a Senate bill re-authorizing E-Verify. This is a procedure that if nobody is on the floor to object, you can get a bill through. It is supposed to be for non-controversial bills. Sessions' point was that it shouldn't be controversial to simply continue this proven E-Verify program.
But Sen. Menendez stood up to object, saying that H.R. 6633 (the House-passed re-authorization) was better than the Senate one Sessions was offering.
Sessions then said that was fine and that he was changing and offering H.R. 6633.
At that, Menendez suddenly turned on the bill he had been extolling and said he wouldn't allow a vote on E-Verify unless the Senate agrees to add another 550,000 permanent greencards to the 1.1 million already slated for next year! He offered his bill with that surge, and Sessions stood firm saying "NO WAY."
This is what we have known about Menendez from the backrooms for some time, but it is the first time Menendez has exposed himself so clearly and publicly.
We cannot allow the enemies of America's workers to blackmail us. Even though E-Verify is essential in the fight against illegal immigration, we still have to be willing to let it die this week rather than allow massive increases in permanent foreign workers.
No, I am not being stubborn instead of practical.
Consider that the point of E-Verify is to protect American workers -- and communities -- from too many foreign workers.
Does it make any sense to get E-Verify passed by giving away hundreds of thousands more U.S. jobs to other foreign workers?
The point of our fight is to protect American workers and communities. E-Verify is the best tool going (although Congress needs to make it mandatory for it to really start pushing millions of illegal workers to go home). But we will have accomplished nothing by re-authorizing a voluntary E-Verify while flooding American occupations with another 550,000 foreign workers through Menendez' bill.

If anyone is hesistant to call: This is really easy to take so little time to do.
Both of my Senator (WA: Murray and Cantwell) staffers said they would pass the information on. It sounded like Murray may be getting a lot of calls. There was no answer at her Bellevue office but a voice message with a Seattle number that NumbersUSA doesn't have: 206-553-5545 (and a toll free that I missed). I left a message in Bellevue and called Seattle where when I said E-verify with no strings attached, the staffer asked "is that HR 6633?"
Our future depends on it! It takes only 2 minutes to call them both. We have an initiative gathering signatures in WA and the hard work in other states that depend on this!!!
I simply said: "my name is ________ calling from ________ and I would like to ask that Senator ________ help bring E-Verify to the floor with no strings attatched." Short, simple, but at least I got my first calls in! So easy that I am moving on to the Senate leadership calls (suggested by Bay Buchanan at Team America PAC):

Roy, I think you have made the right call on this. I am a Democrat, and I am disgusted by the cynical games my party plays with immigration. It is time for Harry Reid and the party to behave responsibly. I think that is the absolute minimum expectation of a party that is asking us to let them lead the country. We send these people to Washington to serve, but once they get there a lot of them seem to think their only job is to find ways to stay in Washington. Thanks to their calculated blindness on immigration and the irresponsibility of Menendez the party is going to take a hit on this, but it is their first responsibility to do what is right for our country. Tens of millions of American workers and their families shouldn't have to take the hit in lost jobs and lower wages. It is time for elected Democrats to remember what it is to be a Democrat. Let us be proud of them again, instead of ashamed.

Sadly we are represented[?] by the Senator whose position on e verify is the source of the problem. His pal , Lautenberg[Sen], is on board with him. So I ask you, how effective would a fax to their offices be? I suspect it is a waste of time but I will be sending it to them if you encourage it.
NumbersUSA Moderator: Communicating with your elected officials is never a waste of time. Even if a Representative or Senator is unlikely to support our positions, your calls and faxes can (and often do) make them pause before committing themselves to something they know is unpopular. Keep those calls and faxes going!

I agree with the need to wxtend EVerify to protect the American worker. We are in a financial mess right now and we don't need 550,000 more foreign workers in this country to take away jobs from Americans and increase the services required for the foreign workers paid for by American taxpayers. It is time to think about Americans first.

Most white collar jobs who will be consuming these half million plus green cards already check for legal status so E_Verify does not help the American workers affected.
Essentially Menendez is asking for a real permanent giveaway for a promise of action - something that has already failed in our entire financial system as we know very well last week. The law is already on the books - E-Verify is simply one tool.
Let it die - this compromise is NOT required and NOT worth it.

To All Americans. I live in southwest Missouri where we are becomming over-run with known illegal Mexican workers with families. Most are somehow getting welfare with free doctor care and welfare. I called my two Senators this morning to talk about the House approved H.R. 6633 E-Verify Bill that is now in the Senate being held up by one Senator, New Jersy Menedez. Both staff members I talked to said they are receiving calls about this subject from the time they open till the time they close. I ask you all to not be afraid to call your Senators. Talking to a staff member is easy to do. They will listen and are requiered to report all calls and faxes, etc. If you are to shy to talk to a staff member you can call early in the morning and leave a message. They also are all heard and reportted. I at this time am watching Presidential runner McCain talk about Immigration reform. He is saying that we need these foreign workers for the good of America. But what he is not talking about is the millions of American's out of work already from the illegals here now being hired by greedy owners of factories and all businesses. Right now I need a new roof put on my home because of the tornados that hit our area. I called out to my home 5 contractors and ALL had Mexican worker crews. I asked all if they checked to see if they were leagally here to work and ALL 5 said they did not care. I was floored by this and told them all what I thought of them and of course did not hire them. We all need to do this. I need my roof fixed bad but I cannot and will not hire any foreign workers to do the job. Please use Nummbersusa's tools to fax, call, or write your Congressmen/womwn. It does matter. I have a file full of return letters from mine that I keep so I can go back on them if they do not vote for American's. P.S. I am voting For Bob Barr.
