SAN FRANCISCO -- The California Supreme Court on Tuesday upheld same sex marriages that were already performed but upheld voters' rights to ban gay marriage through the state constitution.
An estimated 18,000 gay couples tied the knot before the law took effect. The ruling suggests that gay couples can be afforded equivalent rights to heterosexual married couples but perhaps under a different name.
Gay rights demonstrators flooded the courthouse before the decision and immediately started protesting the ruling. Supporters of gay marriage had argued that the Legislature should have approved the change to the California constitution because of the vote's impact on the equal protection clause.

I believe that this will be on the ballot again (in another form) in 2010 and will reverse Prop 8. With the voting numbers increasing in favor of same sex marriage it's just a matter of time before this becomes acceptable by the majority in California.

I personally have no stake in this either but find the irony interesting since the polls showed homosexuals favored Obama over McCain. There was a real push to get Blacks and Hispanics out to the polls to vote for Obama, but these 2 groups voted overwhelmingly in favor of Prop 8 and based on the article I read the day after the election, were the determining factor as to why it passed. I guess it shows that sometime you have to be careful what you wish for.

Gay Americans who wish to be legally married can currently have the ceremony in at least four states or in Canada.

The range of states offering equal legal rights to them will do nothing but continue to increase.

i agree that more states will allow it in the near future. also at the other political forum i post at theres talk of appeal. i just dont care though either way.

Other states which follow their lead - and that of the more prudent strategies employed within MA and VT - will be the ones most likely to change existing policies the soonest.

I don't understand homosexuals.

All of the legal rights and financial benefits of normal marriage ( with the exception of the marriage tax penalty:) are available to homosexuals by way of legal partnerships and small corporation pass through law.

So what do they really want from us?

They want to be able to scream:"Hey, look at me! HEY, LOOK AT ME!
WE'RE HERE, AND WE'RE QUEER!"

They really want approval for their repugnant behavior.
