On 6 August 2013, U.S. officials confirmed that Abu Khattala had been charged with playing a significant role in the attack. According to NBC, the charges were filed under seal in Washington, DC in late July 2013.
Khattala a suspected ringleader of the 2012 attacks in Benghazi, Libya, that killed a U.S. ambassador and three other Americans, was brought from a Navy warship to the federal courthouse in the District of Columbia, where he entered a plea of not guilty to a single conspiracy charge.

I suspect he will die of old age before he goes to trial much less being convicted.
