The Environmental Protection Agency said in court filings Tuesday that it may have lost text messages from former EPA administrator Gina McCarthy that it was required to preserve under federal law
The Competitive Enterprise Institute (CEI), a conservative think-tank, filed a Freedom of Information Act lawsuit last year against the EPA last year seeking the text messages, which CEI said McCarthy and other officials used to skirt federal record law.
The Hill reports:
In the Tuesday filing to the United States District Court for the District of Columbia, Justice Department lawyers representing the EPA said the agency will soon file a notice that it has misplaced records that it was legally required to retain.
“Defendant has decided to formally notify the National Archives and Records Administration (NARA) about the potential loss of federal records relating to text messages,” the lawyers told the court.
Once it files that notice the CEI’s claim will become moot, since the records do not exist, the agency said. Lawyers will ask the court for a hearing to dismiss the case.
Earlier this year, the Internal Revenue Service said it lost thousands of emails from IRS official Lois Lerner due to a hard drive crash.
In both cases, the federal agencies did not notify the NARA that it had failed to preserve federal records until forced to under pressure from outside groups and Congress.

speaking of transparency we have an elected rep (at a whopping 88% btw) who doesn't believe citizens are supposed to know what their govt is up to. :)

is from july but just ran into it and thought it appropriate for the discussion on transparency. haven't heard anything this bizarre since Guam was ready to capsize

Remember when the Obama Administration was meant to serve as the model for how a transparent government is supposed to operate? That promise of “hope’n’change” has produced the most secretive government administrations in the history of this nation.

To add insult to injury, the Democrats have continually fought to defend the president’s violations, abuses and secrecy with a hubris not seen in government since the days of King Louis XVI.

On Friday, Eleanor Holmes Norton, the non-voting congressional representative for the District of Columbia, defended the Obama Administration angrily as she declared that Americans have no right to know what goes on in their government.
“You don’t have a right to know everything in a separation-of-powers government, my friend. That is the difference between a parliamentary government and a separation-of-powers government,” Norton claimed during a House Oversight and Government Reform Committee hearing.
Allow me to make this clear: A Democrat representative told the House Oversight Committee that they have no right to scrutinize government. The committee, as the name would suggest, is responsible for overseeing the federal government as a check against abuses of power.

What Norton seems to have confused is that it is the very principle of scrutiny that defines a government that is equipped with a separation of powers. Each branch of government checks the power of the other branches of government.

It’s amazing that America possesses even one citizen who would believe such an obvious falsehood; it’s even more outrageous that America has a representative in Congress who believes this.

We are starting to see why the framers of the constitution were such genius. They were able to hold this shit off for over 200 years.

Now that is gone and we are seeing the results.

That's stretching it trolltide! The context of which she said the comment is 100% accurate. But just like the "you didn't build that", conservatives have no shame in their behavior. Shame on you!

In order to stretch something you first have to grasp it. RT does, you don't. You don't get it and you never will. If you believe everything that Norton said then that says it all. Are you tired of apologizing for Obama and just moving on to support fellow libtards. She is on the oversight committee LOL. Arguably among the most brilliant men who ever walked the planet. They created a system designed to give the individual the right to life, liberty and the pursuit of happiness while limiting the power of the government. A lot of good shit falls under those three umbrellas, except surprisingly few people exercise those rights because they really don't understand them.

No government is capable of creating a system that guarantees everyone will have their own beach house, Ferrari and an enormous bank account. It just isn't possible, yet dimocraps like to pretend it is. Better yet, they pander to the emotions of the braindead segment of the population by taxing those "evil rich" people. Why the fuck some welfare loser should feel happy about seeing a successful person pay more taxes is beyond me. How exactly does that make your life better?

A lot of Americans have never lived through an oppressive regime, so they can't recognize the signs of traveling down that road. If you really want to know what it's like, ask an immigrant from a formerly communist country why they came to the States. And that's exactly where the Stuttering Clusterfuck wants to steer the country if he gets his way.

Obama is the one who broadcast his promise to have the most transparent administration ever. The fact that he said that and the fact that he and his administration has not adhered to that promise must mean he intentionally lied from the get go. That was one of many promises to the uninformed that got him into office and the very one's who do not keep up with day to day politics. You know, the one's who don't even know who Joe Biden is etc. LOL Had he not made that promise it might be different but he did. It was the first of many lies on his behalf and of his administration. He even recently bashed Fox who monitors his lies. History will eventually prevail and his record (or lack thereof) will speak for itself (no monitors required). I guess by transparency that we would be able to see right through. True that.
