If someone runs a very small picks service (tout) via website and that websites server is based in the US, is it illegal to display banner advertising for offshore books? Secondly, if that sites server was canadian but the webmaster lived in the US, would that be illegal?

Just to confirm, I don't reccomend anyone breaking the law and am only asking the question because I would like to stay within the boundaries of the law.

No, because you are not acceptin wagers nor are you placing them. Also, caribsports used to advertise on the back of AA or AmericaWest (Before the merger with US Airways) boarding pass jackets.

Thanks Bigten, you've kinda confirmed my own thoughts although internet research has told me that Google and Yahoo were fined for accepting advertising from offshore books and subsequently don't accept any such advertising. I asked the question because one attorney told me it was ok and another said it was a gray area because technically you would be assisting people to unlawfully gamble online.

well i'm sure you have to denote that your information is for entertainment only and any use of the information to break laws would be prohibited.

Not a lawyer, just a first-year law school student: Your biggest concern will be if you advertise actual line numbers or not. That is still somewhat of a gray area because the original laws used the fact that lines were phone around to make it a Federal law - the Interstate Gambling act. So, it could be found that your transmission of lines on the web crosses state lines

Paranoid: Thanks for your time, you're correct, it's a massively gray area. I spoke to a leading offshore this morning and they also confirmed it's a gray area but pointed out 1000's of people do it and none have had any problems yet. I also spoke to two attorneys and they both said different things. Acting on the various pieces of advice I've been given I'm going to get my pages hosted out of Canada. Apparently that puts you below everyone who uses clickable banners at US hosts if anything were to ever happen whereby the law were looking to make an example. Thanks again for your time.

I asked the question because one attorney told me it was ok

case closed, now get it in writing from that attorney. If you ever get arrested just pull out your get out of jail free card. You sought legal advise from a lawyer, and got it. congrats
