KNOXVILLE -- One of the most important developments in the University of Tennessee's lengthy case with the NCAA was former coach Lane Kiffin receiving a failure-to-monitor charge instead of the Volunteers' football program.

The university's response to the NCAA, which UT released to the Times Free Press on Monday, explained the details of why Kiffin, who left UT for Southern Cal after one season, was given the charge. After receiving the NCAA's Notice of Allegations in February, UT formally responded in May and went before the Committee on Infractions in June.

Contained in the 190-page document is UT's reply to each of the alleged 10 major infractions against the men's basketball and football programs, the school's self-imposed two-year probation and the other punitive actions the school imposed on former and current football and basketball coaching staffs.

While the document vividly describes the downfall of UT's former basketball staff with transcripts of the conversations former head coach Bruce Pearl and assistants Tony Jones, Steve Forbes and Jason Shay had with NCAA investigators in which they admitted to the lies and attempted cover-up that ultimately led to their firings in March, the football portion of the case is still shrouded with some mystery.

The NCAA lumped four separate recruiting infractions of a secondary nature into one major infraction, though two of those violations involving former assistant David Reaves are heavily redacted to protect the identity of former or current UT students.

Now the offensive coordinator at New Mexico, Reaves allegedly had UT students contact football recruits illegally, which UT disputed in its response, and his involvement in two members of UT's now-defunct Orange Pride hostess group attending a high school game in South Carolina is the biggest mystery in this case.

"The university does not believe it is appropriate to cite Kiffin for failing to monitor Reaves in that instance," the response states. "Rather, the weight of the evidence is that Reaves acted on his own and without notice to Kiffin. However, as the head coach, Kiffin was ultimately responsible for all employees of the football program."

As for the 16 impermissible phone calls during a Jan. 3-9, 2010, contact period and the impermissible in-person off-campus contact of then UT recruiting intern Steve Rubio with administrators at St. Thomas Aquinas High School in Fort Lauderdale, Fla., UT said it provided Kiffin with enough information that he should have prevented the violations.

From December 2008 to January 2010, UT's compliance staff "provided no fewer than 135 rules-education items" to football coaches and administrators.

"When the university began hiring the former football staff ... the compliance staff immediately began a campaign to fully educate the staff on all aspects of NCAA rules," the response states. "The compliance staff was particularly focused on rules education for the football staff at that time because several of the football coaching staff members were returning to college football from careers in the National Football League."

Brad Bertani, UT's associate athletic director for compliance, said he "vividly" remembered having conversations with the staff "about the impermissibility of certain contacts" just a month before the illegal calls were made.

During the 2009 contact and evaluation period, UT's senior associate athletic director David Blackburn said Bertani and coordinator of football operations Kyle Strongin "were in frequent communication about the permissibility of the coaches' activities," according to the response. Though Strongin also confirmed he relayed Bertani's messages to the coaches, Kiffin said he "did not recall" the compliance staff providing any specific information on illegal calls.

On their recruiting trip to Florida, Kiffin brought Rubio because he attended St. Thomas Aquinas and his familiarity with the area would help Kiffin more easily navigate the area. Rubio had no contact with any prospects while in the school, speaking only with his former coaches and teachers, according to the response.

Blackburn said he specifically told Kiffin on the eve of the trip and Rubio during the trip that Rubio wasn't allowed to enter any schools. Kiffin said it was a "rare circumstance," so he allowed Rubio to enter "to see his old buddies."

"In both instances," the response said, "Kiffin was in a position to have prevented the violations before they occurred."

UT's ability to pin the failure-to-monitor charge and the illegal recruiting on former coaches, along with corrective actions and cooperation with the NCAA, should alleviate the NCAA's pending penalties, which could come sometime next month.

"The university is deeply disappointed that these violations have occurred," the response states. "The depth of the disappointment is matched only by its commitment to doing whatever is necessary to restore the reputations of its men's basketball and football programs. That commitment is perhaps most visibly evidenced by the hiring of Derek Dooley as head football coach and Cuonzo Martin as head men's basketball coach. Both men have impeccable reputations for integrity and compliance with governing rules and regulations."

Looks to me like they just threw an ex-coach under the bus. It does not mention the AD who quit and left with a nice goodbye package. How many people do you know who quit their job and get rewarded for it. Wonder what he knows. I notice he was not referred to in this nice in house article. I guess that's it, no sense in the NCAA going any further just pin the tail on the ex-coach. If all he did was let Rubio go in the school with him I say whoopdeedoo. This investigation covered basketball and football. Did I miss something or did Kiffin coach BB also. I think multiple sports have more to do with an AD than anything else. It begins and ends with the AD and goes downhill from there. I think that if CP would personally write a letter to the NCAA they would probably drop this whole thing right then and there.
I notice the byline is "Knoxville", what do you expect them to put in an article.

I didn't get it either. They worded as though the word Tennessee is another word for a violation or crime. Of course when I think of Tennesse I always think of the Fulmer Cup. Which I guess is the same thing.

CP is the first to jump all over an Oregon etc for……whatever. The biggest homer of them all shows no mercy when he attacks other schools or their fans who might post on the forum. And now he starts this thread which appears to throw the spotlight on Kiffin, who left Tenn for a better job. Of course CP’s source appears to be a Knoxville news source.

I guess the insinuation is that Kiffin was a rogue who could not be controlled by a school that has been involved with the NCAA as long as anybody. But in the midst of all the hoopla what was really wrong at Tenn, was it just Kiffin. In fact was it just football. Answer……no.
The basketball program was cited and the baseball program also. They did not pursue the baseball violations because nobody really gave a shit. The basketball charges resulted in Pearl being fired. However, the University agreed to pay Pearl $948,728 worth of salary and benefits as part of his dismissal agreement.

Now lets take a look at who hired Kiffin and Pearl, Mike Hamilton. Now first consider that Pearl had been involved in a recruiting scandal while an asst coach at Iowa. Pearl basically accused Illinois (Urbana-Champaign) of improper recruiting and making a financial offer to a player who shunned Iowa and wound up going to Illinois. In the end it was all smoke and Pearl was frowned on by many baseketball coaches and some think was blackballed at that point. That was 1989. In 2005 Tenn AD Hamilton hired Pearl. In 2010 Pearl acknowledged that he made inappropriate recruitment contacts and then provided false information to the NCAA. After that his salary was reduced, he was suspended for a few games, then some more violations occurred and he was finally fired.

So Mike Hamilton hired both these guys. All this happened right in front of him and he never saw or heard anything? Well eventually Hamilton becomes the sacrificial lamb and resigns. He, like Pearl, received a buyout of $1,335,000. So UT pays out $2,283,728.00 to two guys who disgraced their programs and their schools. Although Hamilton is not named personally he ran the show and apparently got paid very well to make sure Tenn complied with the NCAA on a day to day basis.

Not everyone has the time or the inclination to look into all of this. But knowing all of this does call the headline that tops this thread into question. Now keep in mind that Tenn was Kiffin’s first NCAA head coaching job. He was green on recruiting and much more. But he was the guy that Tenn wanted and he was hired by Mike Hamilton the AD. Hamilton is the same guy who fired Tenn coaching legend Phillip Fulmer. When Hamilton left Tenn Chancellor Jimmy Cheek said Hamilton was not forced out and that it was Hamilton’s decision to step down. So, $2,283,728.00 later this mess is still hanging, but according to the title of this thread it is all on Kiffin. Whatever.

Boo hoo. Just man up. Admit Tenn is in a big mess and that what was wrong permeated the men's programs. Hamilton was the honcho dude. What bothers most people on here is that you come down on Oregon and Kelly so hard. Why. No skin off your ass. Same goes with Tenn because noody actually gives a shit about them either. But when you start a thread that seems to pin the tail on Kiffin like he is the core of the problem that is just wrong. I have said it before I like Tenn and they have a long history and tradition. I love their stadium and have been there. I am not after a cage match I just like to see all the facts on the table. Fact is that Tenn was systemically violating NCAA rules in multiple sports. I say Hamilton should have the tail pinned on him because he ran the show. Kiffin is small potatoes in this whole thing. A rookie college coach should have been under scrutiny from the AD from day one. Now this article makes him out to be a rogue. Come on, it is what it is.

your post right there is exactly why i posted what i did. ignorant people like you have been under the assumption that tennessee football is in some sort of serious trouble. forget baseball and basketball this is a football forum. the sports are not connected when it comes to punishments. they can drop those two for all i care. several times this summer you have claimed tennessee football had to fear an investigation and i told you they were fine it was kiffin who will take the brunt. the time is gettign closr for him to get his punishment and i dont think most the nation has a clue. it will be some drama on ESPN when it happens, everyone will be shocked . right or wrong hes gettin burnt? i dont give a fuck that doesnt matter . im hear to correct lies and give true information. Oklahomas recent probation as result of a FAILURE TO MONITOR is worse than what Tennessee will get since they avoided the failure to monitor. that should be easy to understand. did you even know Oklahoma is just coming off probation? you should understand the importance of that and what it will mean to Lane Kiffin (theres a real chance he gets a show cause and Ed Orgeron will be dealt with too) reasons be damned, im here to educate the uninformed and misinformed public. that includes the duck fans in denial. sometimes it steps on toes and hurts peopls feelings. but my track record speaks for itself, i know what the fuck goes on in college football. if people are too sensitive to accept the facts ill just stop sharing them since its viewed as some sort of "hating" or "homerism". grw up and learn to talk without arguing. all i did was posted an article in the CHATANOOGA paper (not knoxville like you have said 4 times genius) ,of course the story is out of knoxville since the papers were released from UT, and you go all bonkers

Maybe you are a little sensitive yourself, especially concerning Tenn. Look 3 people were involved and all are gone. One moved to a better job, the other two got paid off handsomely. I don't think I am misinformed that is why I put it all out there not just a squeeze job like you are highlghting on this thread. You say it's not serious as far as Tenn is concerned, we shall see. I you want to correct lies then lay everything out there. That is what my first post was about, laying it out there. Did I misrepresent anything in that post? I would like for you to tell all of us misinformed how you feel Hamilton stacks up in this whole deal. Why did Tenn overpay him on the way out and make it so clear that it was all voluntary on his part. Inform the uninformed if that is your mission. I would love to hear your slant on that.

i dont care who is at fault, who is to blame, who did what. all i care about is the bottom line - who gets punished and how it matters in the upcoming season. Hamilton wont get a suspension hes unemployed , Kiffin probably will at the least miss a few games if he keeps his job. i think this is information important to college football gamblers as they buy their futures . nobody here gives a shit about Bruce Pearls buyout. you cant see the forest for the trees. im not hear to argue, im here to help the uninformed. take it for what its worth instead of trying to fight. you spazz at like a pup humping a leg anytime i post and miss the importance.

ill continue to warn people that Oregon is fucked and Kelly will lose his job because the vocal majority here are homers that are flat out in denial. gamblers need to know when the Ducks lose their best defensive player for the season opener since they are a top 5 team . but you guys get more excited when a mediocre LB from TN gets arrested for drinking . its all childish and needs to stop.
