Federalists might be interested to know that Judge Roberts' wife served on the Board of Directors for Feminists for Life of America from 1995 to 1999 during which time she focused on passing the Violence Against Women Act. This is an Act that was partially invalidated by the conservative bloc of the SC and has drawn the rage of federalists for its invocation of the commerce clause.

Would a Justice Roberts have ro recuse himself from deciding issues related to the VAWA because of his wife's involvement?

Based on that and some other stuff, Judge Reoberst may be a federalist but his wife doesn't appear to be.

I can see why the Gameface's of the world are "concerned".

I'm starting to like this guy. Not perfect of course, but in regards to whom Bush could have chosen, this is about the best that could have been hoped for. I think he'll be understated in his jurisprudence and won't look to overturn decades of precedent, even if he would have voted the other way had he been on the court in the past. So long as he accepts for the most part stare decisis then he is acceptable for the court. It's these "constitution in exile" wackjobs that are scary.

Well said, D2. Unfortunately, with the inbred red-staters ensuring another 4 years of incompetence we're forced to lower our expectations.

Bush usually fuks up his choices on a much larger scale, so relatively speaking -- I, too, am satisfied with the selection of Roberts.

I'm sure he will be confirmed. D2, what do you mean by "constitution in exile" types? I think banning cannabis and other drugs (for instance) is unconsitutional, notwitshstanding any prior supreme court bullshit decisions.

He is definately qualified, and seems to be his own man. I like the choice, regardless of how he may vote on any one issue.
